From the letter:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\"><em>Now is the time for Congress to act and ensure that consumers are not faced with confusion about their rights and protections based on a patchwork of inconsistent state laws.<\/em><\/p>\n<p>Among the items hidden deep in the CEO&#8217;s &#8220;<a href=\"https:\/\/s3.amazonaws.com\/brt.org\/privacy_report_PDF_005.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">consumer privacy framework<\/a>\u00a0[more\u00a0<a href=\"https:\/\/web.archive.org\/web\/20201014191240\/https:\/\/www.businessroundtable.org\/policy-perspectives\/technology\/privacy-2\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>]&#8221; are some <strong>onerous provisions<\/strong>.<\/p>\n<ul>\n<li><strong>Private individuals should not be allowed to sue<\/strong> companies if those companies violate the data privacy law itself.<\/li>\n<li>Potential <strong><a href=\"https:\/\/blog.malwarebytes.com\/security-world\/privacy-security-world\/2019\/02\/will-pay-privacy-new-normal\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"pay-for-privacy (opens in a new tab)\">pay-for-privacy<\/a><\/strong> schemes and<\/li>\n<li><strong>Overriding<\/strong> <strong>existing state data privacy protections already signed into law<\/strong>.<\/li>\n<\/ul>\n<p>The <em><a href=\"https:\/\/dataprivacyblog.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Data Privacy Blog<\/a><\/em> <a href=\"https:\/\/dataprivacyblog.com\/the-push-for-a-national-data-privacy-law-continues-as-tech-giants-write-to-congress\/\" target=\"_blank\" rel=\"noopener noreferrer\">points out<\/a> that in 2019, a number of states <a href=\"https:\/\/www.dataprotectionreport.com\/2019\/06\/nine-states-pass-new-and-expanded-data-breach-notification-laws\/\">passed<\/a> <strong>new and expanded data breach notification laws<\/strong>, including:<\/p>\n<ul>\n<li><a href=\"https:\/\/blog.malwarebytes.com\/privacy-2\/2019\/07\/changing-californias-privacy-law-a-snapshot-at-the-support-and-opposition\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"California (opens in a new tab)\">California<\/a>.<\/li>\n<li><a href=\"https:\/\/www.psychologytoday.com\/us\/blog\/conceptual-revolution\/201801\/the-communication-trap\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-106364\" title=\"data breach notification laws\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/megaphone.png?resize=110%2C86&#038;ssl=1\" alt=\"data breach notification laws\" width=\"110\" height=\"86\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/megaphone.png?resize=150%2C118&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/megaphone.png?resize=75%2C59&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/megaphone.png?w=320&amp;ssl=1 320w\" sizes=\"auto, (max-width: 110px) 100vw, 110px\" \/><\/a>Illinois,<\/li>\n<li><a href=\"https:\/\/blog.malwarebytes.com\/privacy-2\/2019\/06\/maine-governor-signs-isp-privacy-bill\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Maine (opens in a new tab)\">Maine<\/a>,<\/li>\n<li>Maryland,<\/li>\n<li>Massachusetts,<\/li>\n<li>New Jersey,<\/li>\n<li>New York,<\/li>\n<li>Oregon,<\/li>\n<li>Texas, and<\/li>\n<li>Washington.<\/li>\n<\/ul>\n<p>Also, since July 1, 2019, <a href=\"https:\/\/news.delaware.gov\/2019\/08\/01\/insurance-data-security-act-signed-into-law\/\">Delaware<\/a>, <a href=\"https:\/\/legiscan.com\/NH\/text\/SB194\/id\/2037480\">New Hampshire<\/a>,\u00a0and\u00a0<a href=\"https:\/\/www.cga.ct.gov\/2019\/ACT\/pa\/pdf\/2019PA-00117-R00HB-07424-PA.pdf\">Connecticut<\/a> have enacted laws imposing new <strong>cybersecurity requirements on insurance companies<\/strong>.<\/p>\n<p><em><a href=\"https:\/\/www.zdnet.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">ZDnet<\/a><\/em> <a href=\"https:\/\/www.zdnet.com\/article\/51-tech-ceos-send-open-letter-to-congress-asking-for-a-federal-data-privacy-law\/\" target=\"_blank\" rel=\"noopener noreferrer\">points out<\/a> that many privacy advocates (<a href=\"https:\/\/www.washingtonpost.com\/opinions\/policy-decisions-should-be-made-by-elected-representatives-not-silicon-valley\/2019\/09\/05\/e02a38dc-cf61-11e9-87fa-8501a456c003_story.html\" target=\"_blank\" rel=\"noopener noreferrer\">and even some tech CEOs<\/a>) believe the <strong>CEOs aren&#8217;t really looking after users&#8217; interests<\/strong>, but their own. There&#8217;s a belief that companies are trying to <strong>aggregate any privacy lawmaking in Congress<\/strong>, where <strong>lobby groups can water down any meaningful user protections<\/strong> that may impact bottom lines. <a href=\"https:\/\/www.opensecrets.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">Open Secrets<\/a> reports that the Business Roundtable has spent over <a href=\"https:\/\/www.opensecrets.org\/lobby\/clientsum.php?id=D000032202\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>$6.6M lobbying<\/strong> in D.C.<\/a> so far in 2019. Privacy policies with too many teeth could <strong>prevent companies from selling your data<\/strong> to pay the CEO&#8217;s <a href=\"https:\/\/www.latimes.com\/business\/story\/2019-08-19\/column-trickle-down-is-a-lie\" target=\"_blank\" rel=\"noopener noreferrer\">average salary of $17.2M<\/a>. The <em><a href=\"https:\/\/www.latimes.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">LA Times<\/a><\/em> <a href=\"https:\/\/www.latimes.com\/business\/story\/2019-08-19\/column-trickle-down-is-a-lie\" target=\"_blank\" rel=\"noopener noreferrer\">reports<\/a> that compensation for American chief executives increased by 940% from 1978 to 2018, while pay for the average worker rose only 12% over the same 40-year period.<\/p>\n<p><em><strong>rb-<\/strong><\/em><\/p>\n<p><em>Seems to me that the goal of this proposal of the leading CEO&#8217;s is not to protect our privacy. Their goal is to centralize the rule-making in the D.C. swamp and throw money at the politicians to do the Business Roundtable&#8217;s bidding.
