The current draft would <strong>allow the president to &#8220;declare a cybersecurity emergency&#8221; on &#8220;non-governmental&#8221; computer networks<\/strong> and do what&#8217;s necessary to respond to the threat.<\/p>\n<p><a href=\"https:\/\/web.archive.org\/web\/20180111032336\/https:\/\/www.engineering.com\/Blogs\/tabid\/3207\/ArticleID\/7391\/Persistent-Security-Threats-Push-Organizations-to-Continuous-Vulnerability-Monitoring.aspx\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"wp-image-110722 alignright\" title=\"Feds Still Want to Federalize Net\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/computer_security-2.jpg?resize=100%2C85&#038;ssl=1\" alt=\"Feds Still Want to Federalize Net\" width=\"100\" height=\"85\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/computer_security-2.jpg?resize=150%2C127&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/computer_security-2.jpg?resize=75%2C64&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/computer_security-2.jpg?w=333&amp;ssl=1 333w\" sizes=\"auto, (max-width: 100px) 100vw, 100px\" \/><\/a>Section 3 (2) (B) Defines &#8220;Cyber&#8221; as any matter relating to, or involving the use of, computers or computer networks. Section 201 (2) (B), permits the president to &#8220;direct the national response to the cyber threat&#8221; if necessary for &#8220;the national defense and security.&#8221;<\/p>\n<p>&#8220;<em>I think the redraft, while improved, remains troubling due to its vagueness,<\/em>&#8221; Larry Clinton told <em>CNET<\/em> &#8220;<em>It is unclear what authority Sen. Rockefeller thinks is necessary over the private sector. Unless this is clarified, we cannot properly analyze, let alone support the bill,<\/em>&#8221; said Clinton, president of the <a href=\"https:\/\/web.archive.org\/web\/20220204175740\/https:\/\/isalliance.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">Internet Security Alliance<\/a>, which counts representatives of Verizon, Verisign, Nortel, and Carnegie Mellon University on its board.<\/p>\n<p><a href=\"https:\/\/youtu.be\/-F6B5NVnUOg?t=63\" target=\"_blank\" rel=\"noopener\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-110718\" title=\" Senate Intelligence Committee Chairman JAY ROCKEFELLER (D-WV)\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/Senator_Jay_Rockefeller.jpg?resize=110%2C79&#038;ssl=1\" alt=\" Senate Intelligence Committee Chairman JAY ROCKEFELLER (D-WV)\" width=\"110\" height=\"79\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/Senator_Jay_Rockefeller.jpg?resize=150%2C108&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/Senator_Jay_Rockefeller.jpg?resize=75%2C54&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/Senator_Jay_Rockefeller.jpg?w=300&amp;ssl=1 300w\" sizes=\"auto, (max-width: 110px) 100vw, 110px\" \/><\/a>A Senate source familiar with the bill told <em>CNET<\/em> that the <strong>president&#8217;s power to take control of portions of the Internet<\/strong> is comparable to what President Bush did when grounding all aircraft on <strong>Sept. 11, 2001<\/strong>. The source said that one primary concern was the electrical grid, and what would happen if it were attacked from a broadband connection.<\/p>\n<p>Section 201 (5) the bill requires the White House to <strong>engage in &#8220;periodic mapping&#8221; of private networks<\/strong> deemed to be critical, and those companies &#8220;shall <strong>share&#8221; requested information with the federal government<\/strong>. The <strong>privacy implications<\/strong> of sweeping changes implemented before the legal review is finished worry <a href=\"http:\/\/www.eff.org\/about\/staff\" target=\"_blank\" rel=\"noopener noreferrer\">Lee Tien<\/a>, a senior staff attorney with the <a href=\"http:\/\/www.eff.org\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Electronic Frontier Foundation<\/strong><\/a> in San Francisco told <em>CNET<\/em>. &#8220;<em>As soon as you&#8217;re saying that the federal government is going to be exercising this kind of power over private networks, it&#8217;s going to be a really big issue,<\/em>&#8221; he says.<\/p>\n<p>&#8220;<em>The language has changed but it doesn&#8217;t contain any real additional limits,<\/em>&#8221; EFF&#8217;s Tien says. &#8220;<em>It simply switches the more direct and obvious language they had originally to the more ambiguous (version)&#8230;The designation of what is a critical infrastructure system or network as far as I can tell has no specific process. There&#8217;s no provision for any administrative process or review. That&#8217;s where the problems seem to start. And then you have the amorphous powers that go along with it.<\/em>&#8221;<\/p>\n<p><em><strong>Rb-<\/strong><\/em><\/p>\n<p><em>If your network is determined to be \u201ccritical\u201d by the Feds, there is likely a new set of regulations coming from the same people who are giving themselves <a href=\"https:\/\/news.cnet.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">failing grades<\/a> for their own cyber-security. <\/em><\/p>\n<p><em>These new rules could impact staffing decisions, disclosure policies and open the door to a government can take over your IT systems. This bill requires watching by anybody that uses or manages computers, a private network, or the Internet<\/em><em>.
