The politicians fail to address the <strong>root cause of the problem &#8211; data collection<\/strong>. We can all agree that social media is bad for kids. There is enough proof from <a title=\"Associations of early social media initiation on digital behaviors and the moderating role of limiting use\" href=\"https:\/\/www.sciencedirect.com\/science\/article\/abs\/pii\/S0747563221003769\" target=\"_blank\" rel=\"nofollow noopener\">multiple<\/a>\u00a0<a title=\"Positive and negative uses of social media among adolescents hospitalized for suicidal behavior\" href=\"https:\/\/nocklab.fas.harvard.edu\/files\/nocklab\/files\/ew.pdf\" target=\"_blank\" rel=\"nofollow noopener\">studies<\/a>\u00a0and <a title=\"It\u2019s getting harder for people to believe that Facebook is a net good for society\" href=\"https:\/\/www.vox.com\/recode\/22677911\/facebook-scandal-research-teen-mental-health\" target=\"_blank\" rel=\"nofollow noopener\">former social media company employees.<\/a> Therefore, KOSA is not the answer. It will infringe on the rights and interests of all internet users.<\/p>\n<h3>Kids Online Safety Act<\/h3>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-128293\" title=\"Two-tier Internet in the U.S.\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/KOSA-e1684106742316-150x150.jpg?resize=110%2C110&#038;ssl=1\" alt=\"Two-tier Internet in the U.S.\" width=\"110\" height=\"110\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/KOSA-e1684106742316.jpg?resize=150%2C150&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/KOSA-e1684106742316.jpg?resize=75%2C75&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/KOSA-e1684106742316.jpg?w=629&amp;ssl=1 629w\" sizes=\"auto, (max-width: 110px) 100vw, 110px\" \/>To begin with, the <strong><a title=\"S.3663 - Kids Online Safety Act\" href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/3663\/text\" target=\"_blank\" rel=\"nofollow noopener\">Kids Online Safety Act<\/a><\/strong>, known as KOSA introduced by Senators <a title=\"Richard Blumenthal\" href=\"https:\/\/www.congress.gov\/member\/richard-blumenthal\/B001277\" target=\"_blank\" rel=\"nofollow noopener\">Richard Blumenthal<\/a> (D) and <a title=\"Marsha Blackburn\" href=\"https:\/\/www.congress.gov\/member\/marsha-blackburn\/B001243\" target=\"_blank\" rel=\"nofollow noopener\">Marsha Blackburn<\/a> (R), would establish a two-tier Internet in the U.S. The bill requires that sites that are &#8216;<em>likely to be accessed by kids<\/em>&#8216; act in the &#8220;<em>best interest of users who are 16 or younger.&#8221;<\/em> That means that all platforms would be responsible for mitigating the risk of physical or emotional harm to young users. This includes &#8220;<em>the promotion of self-harm or suicide, encouragement of addictive behavior, enabling of online bullying or predatory marketing.<\/em>&#8221; Sound nice; however, KOSA is not the solution we need. Here are some of the reasons to oppose KOSA:<\/p>\n<h3>Kids Online Safety Act safety<\/h3>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-128294 size-medium\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/escaping-e1684107753900-150x99.png?resize=150%2C99&#038;ssl=1\" alt=\"\" width=\"150\" height=\"99\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/escaping-e1684107753900.png?resize=150%2C99&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/escaping-e1684107753900.png?resize=75%2C49&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/escaping-e1684107753900.png?w=736&amp;ssl=1 736w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/>The KOSA requirements would mandate that platforms have parental controls. These <strong>government-mandated controls<\/strong> could be harmful to kids in abusive situations. <a title=\"90+ LGBTQ and human rights organizations oppose KOSA\" href=\"https:\/\/www.fightforthefuture.org\/news\/2022-11-28-letter-90-lgbtq-and-human-rights-organizations-oppose-kosa\" target=\"_blank\" rel=\"nofollow noopener\">According<\/a> to <a title=\"Fight for the Future\" href=\"https:\/\/www.fightforthefuture.org\/news\" target=\"_blank\" rel=\"nofollow noopener\">Fight for the Future<\/a>, a coalition\u00a0of over 50 civil society groups, \u201c<em>KOSA risks subjecting teens who are experiencing domestic violence and parental abuse to additional forms of digital surveillance and control that could prevent these vulnerable youth from reaching out for help or support.<\/em>\u201d<\/p>\n<p>Additionally, the <strong>KOSA requirements would endanger VPNs<\/strong> (<em>one of the government&#8217;s favorite <a title=\"BI Admits its Claims of \u201cGoing Dark\u201d Were Overblown, Based on Bad Math\" href=\"https:\/\/www.newamerica.org\/oti\/press-releases\/breaking-fbi-admits-its-claims-going-dark-were-overblown-based-bad-math\/\" target=\"_blank\" rel=\"nofollow noopener\">boogey-techs<\/a><\/em>). The group wrote; \u201c&#8230; <em>by creating strong incentives to filter and enable parental control over the content minors can access, KOSA could also jeopardize young people\u2019s access to end-to-end encrypted technologies, which they depend on to access resources related to <a title=\"Brief \u2013 Hidden Harms: Students With Disabilities, Mental Health, And Student Activity Monitoring\" href=\"https:\/\/cdt.org\/insights\/brief-hidden-harms-students-with-disabilities-mental-health-and-student-activity-monitoring\/\" target=\"_blank\" rel=\"nofollow noopener\">mental health<\/a>\u00a0and\u00a0<a title=\"What Parents Need to Know about Encrypted Apps\" href=\"https:\/\/www.fosi.org\/good-digital-parenting\/what-parents-need-know-about-encrypted-apps\" target=\"_blank\" rel=\"nofollow noopener\">to keep their data safe from bad actors<\/a>.\u201d<\/em><\/p>\n<h3>KOSA is government censorship<\/h3>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-128295\" title=\"seeking to make political points\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/making-political-points-e1684108312660-116x150.jpg?resize=85%2C110&#038;ssl=1\" alt=\"seeking to make political points\" width=\"85\" height=\"110\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/making-political-points-e1684108312660.jpg?resize=116%2C150&amp;ssl=1 116w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/making-political-points-e1684108312660.jpg?resize=58%2C75&amp;ssl=1 58w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/making-political-points-e1684108312660.jpg?w=487&amp;ssl=1 487w\" sizes=\"auto, (max-width: 85px) 100vw, 85px\" \/>KOSA would give the<strong> President control over what people see<\/strong> online. The government would create a <a title=\"FOSI\u2019s Views on the Kids Online Safety Act and CAMRA\" href=\"https:\/\/www.fosi.org\/policy-research\/fosis-views-on-the-kids-online-safety-act-and-camra\" target=\"_blank\" rel=\"nofollow noopener\">&#8220;Kids Online Safety Council&#8221;<\/a> that would advise the government on implementing and enforcing KOSA. As a result, the legislation&#8217;s requirement to restrict access <a class=\"tooltip-target\" href=\"https:\/\/www.vox.com\/recode\/2022\/3\/14\/22971618\/earn-it-sesta-fosta-children-safety-internet-laws\" target=\"_blank\" rel=\"noopener\" data-citationid=\"f261a978-191c-62ad-5192-78800591bdc2-9-group\">to topics such as sex education, LGBTQ issues, and mental health<\/a><a class=\"tooltip-target\" href=\"https:\/\/www.vox.com\/recode\/2022\/3\/14\/22971618\/earn-it-sesta-fosta-children-safety-internet-laws\" target=\"_blank\" rel=\"noopener\" data-citationid=\"f261a978-191c-62ad-5192-78800591bdc2-9-group\"> from minors<\/a> could cause platforms KOSA could force platforms to self-censor just to avoid the hassle and costs.<\/p>\n<p>Furthermore, Fight for the Future writes that <strong>censorship would be politically driven.<\/strong> <em>\u201cOnline services would face substantial pressure to over-moderate, including from state Attorneys General seeking to<strong> <a title=\"Banned in the USA: The Growing Movement to Censor Books in Schools\" href=\"https:\/\/pen.org\/report\/banned-usa-growing-movement-to-censor-books-in-schools\/\" target=\"_blank\" rel=\"nofollow noopener\">make<\/a> <a title=\"Florida's governor signs controversial law opponents dubbed 'Don't Say Gay'\" href=\"https:\/\/www.npr.org\/2022\/03\/28\/1089221657\/dont-say-gay-florida-desantis\" target=\"_blank\" rel=\"nofollow noopener\">political<\/a> <a title=\"Misusing Words Like \u2018Groomer\u2019 Isn\u2019t Just Wrong. It\u2019s Dangerous.\" href=\"https:\/\/www.nytimes.com\/2022\/05\/31\/opinion\/child-abuse-grooming-language.html\" target=\"_blank\" rel=\"nofollow noopener\">points<\/a><\/strong>&#8230; KOSA would cut off another vital avenue of access to information for vulnerable youth.\u201d<\/em><\/p>\n<h3>KOSA encourages more data collection<\/h3>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-128296\" title=\"incentivize sites to collect even more information\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/colleecting-PII-e1684109408857-150x139.jpg?resize=110%2C102&#038;ssl=1\" alt=\"incentivize sites to collect even more information\" width=\"110\" height=\"102\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/colleecting-PII-e1684109408857.jpg?resize=150%2C139&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/colleecting-PII-e1684109408857.jpg?resize=75%2C70&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/colleecting-PII-e1684109408857.jpg?w=639&amp;ssl=1 639w\" sizes=\"auto, (max-width: 110px) 100vw, 110px\" \/>According to Fight for the Future, the bill would incentivize sites to <strong>collect even more information<\/strong> about children to verify their ages and place further restrictions on minors\u2019 accounts. They explain,<\/p>\n<p style=\"padding-left: 40px;\"><em>\u201cAge verification may require users to provide platforms with personally identifiable information such as date of birth and government-issued identification documents, which can threaten users\u2019 privacy, including through the risk of data breaches, and chill their willingness to access sensitive information online because they cannot do so anonymously.\u201d<\/em><\/p>\n<p>Therefore, they conclude, \u201c<em>Rather than age-gating privacy settings and safety tools to apply only to minors, Congress should focus on ensuring that all users, regardless of age, benefit from strong privacy protections by passing comprehensive privacy legislation<\/em>.\u201d<\/p>\n<h3>Kids Online Safety Act unintended consequences<\/h3>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-128297\" title=\"unintended consequences\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/conflict-e1684111039961-150x148.png?resize=110%2C108&#038;ssl=1\" alt=\"unintended consequences\" width=\"110\" height=\"108\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/conflict-e1684111039961.png?resize=150%2C148&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/conflict-e1684111039961.png?resize=75%2C75&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/conflict-e1684111039961.png?w=540&amp;ssl=1 540w\" sizes=\"auto, (max-width: 110px) 100vw, 110px\" \/>KOSA would also create unintended consequences. The unintended consequences include driving children to use <strong>less secure or more harmful platforms<\/strong>. The\u00a0Kids Online Safety Act would make kids more vulnerable to online predators who could <strong>exploit their age verification information.<\/strong> It would also undermine the trust and communication between children and parents, as well as between platforms and users.<\/p>\n<h3><em>rb-<\/em><\/h3>\n<p><em>There are <a title=\"Associations of early social media initiation on digital behaviors and the moderating role of limiting use\" href=\"https:\/\/www.sciencedirect.com\/science\/article\/abs\/pii\/S0747563221003769\" target=\"_blank\" rel=\"nofollow noopener\">valid<\/a>\u00a0<a title=\"Positive and negative uses of social media among adolescents hospitalized for suicidal behavior\" href=\"https:\/\/nocklab.fas.harvard.edu\/files\/nocklab\/files\/ew.pdf\" target=\"_blank\" rel=\"nofollow noopener\">concerns<\/a> <a title=\"It\u2019s getting harder for people to believe that Facebook is a net good for society\" href=\"https:\/\/www.vox.com\/recode\/22677911\/facebook-scandal-research-teen-mental-health\" target=\"_blank\" rel=\"nofollow noopener\">about<\/a> the impact of social media on us all. But the Kids Online Safety Act misses the point. Congress should be targeting data collection. Nearly all social media platforms and online businesses collect personal data from their users. T<\/em><em>he <a href=\"https:\/\/www.eff.org\" target=\"_blank\" rel=\"nofollow noopener\">EFF<\/a> <a title=\"Government Hasn't Justified a TikTok Ban\" href=\"https:\/\/www.eff.org\/deeplinks\/2023\/03\/government-hasnt-justified-tiktok-ban\" target=\"_blank\" rel=\"nofollow noopener\">points out<\/a> that all social media firms harvest and monetize our personal data and incentivize other online businesses to do the same. The result is that detailed information about us is widely available to purchasers, thieves, and government subpoenas.<br \/>\n<\/em><\/p>\n<p><em>Consider\u00a0<a href=\"https:\/\/www.eff.org\/issues\/location-data-brokers\">location data brokers<\/a>, for example. Our <strong>apps collect detailed records<\/strong> of our online activities without our knowledge or genuine consent. The app developers sell it to data brokers, who will in turn <strong>sell it to anyone who will pay for it<\/strong>. An <a href=\"https:\/\/web.archive.org\/web\/20240525175212\/https:\/\/www.eff.org\/ko\/deeplinks\/2022\/05\/data-brokers-and-true-vote-are-villains-dinesh-dsouzas-latest-movie\">election denier<\/a>\u00a0bought it to try to prove voting fraud. One broker sold data on who had visited\u00a0<a href=\"https:\/\/www.eff.org\/deeplinks\/2022\/05\/safegraphs-disingenuous-claims-about-location-data-mask-dangerous-industry\">reproductive health facilities<\/a>.<\/em><\/p>\n<p><em>If a bad actor or the <strong>government wanted to buy this data<\/strong>, it could probably find a way to do so. Collecting more data will not stop the bad actors from acquiring PII. <\/em><\/p>\n<p><em>The better approach is to limit how all businesses collect personal data.
