The idea is that an ISP can\u2019t discriminate against the traffic traveling over its network. Network neutrality is an enshrined legal right in some areas and a hotly contested regulatory fight in others. <span class=\"post-meta the-author\"><a title=\"Posts by Stacey Higginbotham\" href=\"http:\/\/gigaom.com\/author\/shigginbotham\/\" target=\"_blank\" rel=\"author noopener noreferrer\">Stacey Higginbotham<\/a> over at <em><a title=\"GigaOm\" href=\"http:\/\/gigaom.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">GigaOm<\/a><\/em> <a title=\"Net neutrality could be a victim under an ITU Internet takeover\" href=\"https:\/\/web.archive.org\/web\/20211026050006\/https:\/\/gigaom.com\/2012\/06\/15\/net-neutrality-could-be-a-victim-under-an-itu-internet-takeover\/\" target=\"_blank\" rel=\"noopener noreferrer\">points us<\/a> over to a<\/span> <a title=\"The Battle For Net Neutrality Flares Up Again: But Which Countries Still Have It?\" href=\"http:\/\/www.techdirt.com\/articles\/20120614\/05230419318\/battle-net-neutrality-flares-up-again-which-countries-still-have-it.shtml\" target=\"_blank\" rel=\"noopener noreferrer\">post<\/a> over at <a title=\"TechDirt\" href=\"http:\/\/www.techdirt.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>TechDirt<\/em><\/a><i> <\/i>that details the UNs efforts to undermine network neutrality. The articles say the <a title=\"International Telecommunication Union\" href=\"http:\/\/www.itu.int\/\" target=\"_blank\" rel=\"homepage noopener noreferrer\">International Telecommunications Union<\/a> is trying to <a href=\"https:\/\/web.archive.org\/web\/20130823064941\/http:\/\/online.wsj.com:80\/article\/SB10001424052702304821304577436681230307676.html?mod=googlenews_wsj\" target=\"_blank\" rel=\"noopener noreferrer\">dictate terms that will affect how traffic flows on the Internet<\/a>.<\/p>\n<h3>UN Internet power grab<\/h3>\n<p><a href=\"https:\/\/www.un.org\/\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-109412 size-thumbnail\" title=\"UN Internet Takeover\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/un_logo-1.png?resize=75%2C63&#038;ssl=1\" alt=\"UN Internet Takeover\" width=\"75\" height=\"63\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/un_logo-1.png?resize=75%2C63&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/un_logo-1.png?w=102&amp;ssl=1 102w\" sizes=\"auto, (max-width: 75px) 100vw, 75px\" \/><\/a>Network neutrality opposition at the United Nations arose earlier this month. The power grab started with proposed rules from the\u00a0European Telecommunications Network Operators Association (<a href=\"http:\/\/www.etno.be\/\" target=\"_blank\" rel=\"noopener noreferrer\">ETNO<\/a>). The article says ETNO wants to gut <a title=\"Network neutrality\" href=\"http:\/\/en.wikipedia.org\/wiki\/Network_neutrality\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">network neutrality<\/a>. <a title=\"Glyn Moody\" href=\"http:\/\/www.techdirt.com\/user\/glynmoody\" target=\"_blank\" rel=\"noopener noreferrer\">Glyn Moody<\/a> at <em>TechDirt<\/em> has read those documents. He clipped the relevant segments to argue that these proposals would effectively make network neutrality illegal. As he writes at <em>TechDirt<\/em>:<\/p>\n<p style=\"padding-left: 40px;\"><em>&#8220;That may sound innocuous enough, but \u201csupporting innovation to provide a value-added service\u201d is a coded way of saying that the telcos should be allowed to abandon net neutrality, something confirmed in one of the accompanying proposals\u2026 &#8220;<\/em><\/p>\n<p>The author says the key sentence in this proposal is \u201c<em>Nothing shall preclude commercial agreements with differentiated quality of service delivery to develop.<\/em>\u201d<\/p>\n<h3>Comcast network neutrality power grab<\/h3>\n<p><em><a href=\"https:\/\/cms.fightforthefuture.org\/tellfcc\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-109414\" title=\"Net Neutraility RIP\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/net_neutraility_RIP-e1571346768786-112x150.jpg?resize=82%2C110&#038;ssl=1\" alt=\"Net Neutraility RIP\" width=\"82\" height=\"110\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/net_neutraility_RIP-e1571346768786.jpg?resize=112%2C150&amp;ssl=1 112w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/net_neutraility_RIP-e1571346768786.jpg?resize=56%2C75&amp;ssl=1 56w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/net_neutraility_RIP-e1571346768786.jpg?w=242&amp;ssl=1 242w\" sizes=\"auto, (max-width: 82px) 100vw, 82px\" \/><\/a><a title=\"Om Malik\" href=\"https:\/\/web.archive.org\/web\/20210524211521\/http:\/\/www.crunchbase.com\/person\/om-malik\" target=\"_blank\" rel=\"crunchbase noopener noreferrer\">GigaOm<\/a><\/em> says that here in the US\u00a0<a title=\"Comcast\" href=\"https:\/\/www.xfinity.com\/overview\" target=\"_blank\" rel=\"noopener noreferrer\">Comcast<\/a> (<a title=\"NASDAQ : CMCSA\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-CMCSA\/\" target=\"_blank\" rel=\"noopener noreferrer\">CMCSA)<\/a> has created a value-added service. Comcast decided to exempt <a title=\"Xfinity\" href=\"https:\/\/web.archive.org\/web\/20141115192210\/http:\/\/xfinity.comcast.net\/\" target=\"_blank\" rel=\"noopener noreferrer\">Xfinity<\/a> traffic delivered via the <a href=\"http:\/\/www.microsoft.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Microsoft<\/a> (<a href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-MSFT\/\" target=\"_blank\" rel=\"noopener noreferrer\">MSFT<\/a>) <a title=\"Xbox\" href=\"http:\/\/www.xbox.com\/en-US\/\" target=\"_blank\" rel=\"noopener noreferrer\">Xbox<\/a> from its 250 GBPS\/month <a title=\"broadband cap\" href=\"http:\/\/compnetworking.about.com\/od\/internetaccessbestuses\/f\/bandwidth-caps-and-limits.htm\" target=\"_blank\" rel=\"noopener noreferrer\">broadband cap<\/a>. The U.S. version of network neutrality regulations allows Comcast to exempt that traffic. The loophole is the Xbox traffic doesn\u2019t travel over the public Internet. The anti-net neutrality loophole exists because the FCC didn\u2019t want to deal with the concept of value-added services on an ISP\u2019s network when it made its network neutrality regulations.<\/p>\n<p><strong><em>rb-<\/em><\/strong><\/p>\n<p><em>GigaOm calls on the UN and the ITU to open up its process. Maybe then UN member countries will think twice about the types of rules they want to enshrine.
