A <a title=\"Boston University\" href=\"http:\/\/www.bu.edu\/\" target=\"_blank\" rel=\"homepage noopener noreferrer\">Boston University<\/a> <a title=\"The Direct Costs from NPE Disputes\" href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=2091210\" target=\"_blank\" rel=\"noopener noreferrer\">study<\/a> crunched the numbers and worked out that the <strong>legal action conducted by &#8220;patent trolls&#8221;<\/strong> cost U.S. companies an estimated $29 billion during 2011.<\/p>\n<p><a href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_Patent_and_Trademark_Office\" target=\"_blank\" rel=\"(uspto) office patent states trademark united and logo noopener noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright\" title=\"United States Patent and Trademark Office (USPTO) logo\" src=\"https:\/\/upload.wikimedia.org\/wikipedia\/commons\/thumb\/7\/75\/Seal_of_the_United_States_Patent_and_Trademark_Office.svg\/280px-Seal_of_the_United_States_Patent_and_Trademark_Office.svg.png\" alt=\"United States Patent and Trademark Office (USPTO) logo\" width=\"85\" height=\"85\" \/><\/a><a title=\"Fortune Magazine\" href=\"https:\/\/web.archive.org\/web\/20140601114159\/http:\/\/money.cnn.com\/magazines\/fortune\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Fortune<\/em><\/a> <a href=\"https:\/\/web.archive.org\/web\/20131230203945\/http:\/\/tech.fortune.cnn.com\/2012\/06\/26\/study-calculates-cost-of-patent-troll-lawsuits\/\" target=\"_blank\" rel=\"noopener noreferrer\">defines<\/a> <strong>patent trolls<\/strong> as entities that own the intellectual rights to innovations without innovating anything themselves, so-called &#8220;<a title=\"Patent troll\" href=\"http:\/\/en.wikipedia.org\/wiki\/Patent_troll\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\"><strong>non-practicing entities<\/strong><\/a>.&#8221; They <strong>buy patents to sue infringers.<\/strong> According to the study, last year, 1,150 companies defended themselves against 5,842 patent troll lawsuits. Nearly half of those companies made less than $100 million during the year, which showed the authors that patent trolls aren\u2019t just a problem for large firms, but rather a problem for smaller firms who have less money to invest in their own research.<\/p>\n<p>The result is that the companies lost $29 billion in direct costs &#8211; legal and licensing fees. The study did not estimate indirect losses for defendants in things like delays in new products, loss of market share, or the need to change products.<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-100347\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/wasted-money.jpg?resize=75%2C100&#038;ssl=1\" alt=\"\" width=\"75\" height=\"100\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/wasted-money.jpg?resize=113%2C150&amp;ssl=1 113w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/wasted-money.jpg?resize=56%2C75&amp;ssl=1 56w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/wasted-money.jpg?w=300&amp;ssl=1 300w\" sizes=\"auto, (max-width: 75px) 100vw, 75px\" \/>Study authors James Bessen and Michael Meurer also found that the <strong>patent troll costs have escalated since 2005<\/strong>\u00a0when the study found a total of 1,401 claims were $6.6 billion in direct costs. The authors say increasing patent litigation in the U.S. is a <strong>significant tax on investment in innovation<\/strong>. To put the figure into perspective the total U.S. spending on research and development is $249 billion in 2009 but it is still a big tax.<\/p>\n<p>Bessen and Meurer said it was rubbish that asserting patents played a socially valuable role in enabling small inventors to realize greater profits from their ideas. The report said that the costs of defending such legal action meant these organizations had less money to invest in their own research.
