The bill would force unsuccessful patent plaintiffs to cover defendants\u2019 legal costs <a title=\"Patent Troll Bill Introduced \" href=\"https:\/\/web.archive.org\/web\/20171210191019\/http:\/\/www.dailywireless.org\/2012\/08\/02\/patent-troll-bill-introduced\/\" target=\"_blank\" rel=\"noopener noreferrer\">according to<\/a> <em><a href=\"http:\/\/www.dailywireless.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">Daily Wireless<\/a><\/em>. Introduced by <a title=\"Rep. Peter DeFazio (D-OR)\" href=\"https:\/\/web.archive.org\/web\/20170702144924\/https:\/\/chaffetz.house.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\">Rep. Peter DeFazio<\/a> (D-OR) and co-sponsored by Rep. Jason Chaffetz (R-UT), the <a title=\"Saving High-Tech Innovators from Egregious Legal Disputes\" href=\"https:\/\/web.archive.org\/web\/20130903113804\/https:\/\/www.eff.org\/sites\/default\/files\/SHIELD_ACT_0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Saving High-Tech Innovators from Egregious Legal Disputes<\/a> (SHIELD) Act is limited to patents related to computer hardware and software.<\/p>\n<p><a title=\"Politics\" href=\"https:\/\/mostodd.wordpress.com\/2011\/04\/22\/laughing-legislator\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright\" style=\"border: 0px none; margin-left: 3px; margin-right: 3px;\" title=\"Politican\" src=\"https:\/\/mostodd.files.wordpress.com\/2011\/04\/92-laughing.jpg?w=645&#038;resize=79%2C73\" alt=\"House of Representaive\" width=\"79\" height=\"73\" \/><\/a>\u201c<em><a title=\"Patent troll\" href=\"http:\/\/en.wikipedia.org\/wiki\/Patent_troll\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">Patent trolls<\/a> don\u2019t create new technology and they don\u2019t create American jobs,<\/em>\u201d DeFazio said in a <a title=\"DeFazio Introduces SHIELD Act to protect American Innovation, Jobs\" href=\"https:\/\/web.archive.org\/web\/20160506020050\/http:\/\/defazio.house.gov\/index.php?option=com_content&amp;view=article&amp;id=792:defazio-introduces-shield-act-to-protect-american-innovation-jobs&amp;catid=69:2012-press-releases\" target=\"_blank\" rel=\"noopener noreferrer\">news release<\/a>. \u201c<em>They pad their pockets by buying patents on products they didn\u2019t create and then suing the innovators who did the hard work and created the product<\/em>.\u201d<\/p>\n<p>The article explains that patent trolls often buy broad patents. The purchase allows them to file flimsy lawsuits against multiple companies for infringement. Despite very thin evidence to back their lawsuits, companies are often forced to settle. They settle because going to court can easily cost over $1 million in legal costs even if the company prevails, explained DeFazio in a press release.<\/p>\n<h3>Loser pays<\/h3>\n<p><a title=\"Electronic Frontier Foundation\" href=\"https:\/\/www.eff.org\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright\" style=\"border: 0px none; margin-left: 3px; margin-right: 3px;\" title=\"EFF Logo\" src=\"https:\/\/i0.wp.com\/www.eff.org\/files\/EFF-logo-trans.gif?resize=98%2C66&#038;ssl=1\" alt=\"Electronic Frontier Foundation\" width=\"98\" height=\"66\" \/><\/a>The <a title=\"Electronic Froniter Foundatoin\" href=\"https:\/\/www.eff.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">Electronic Frontier Foundation<\/a> <a title=\"Can You Believe It? Legislation that Would Actually Help Fix the Patent System\" href=\"https:\/\/www.eff.org\/deeplinks\/2012\/07\/can-you-believe-legislation-would-actually-help-fix-patent-system\" target=\"_blank\" rel=\"noopener noreferrer\">explains<\/a> the idea behind the SHIELD Act is simple. A plaintiff needs to believe that a defendant actually infringes a valid patent before it sues. If it doesn&#8217;t, then the plaintiff could be on the hook for the costs of litigation. They would also have to cover the winning party&#8217;s attorneys&#8217; fees (which can cost hundreds of thousands of dollars in some cases).<\/p>\n<p>Fee shifting, often called &#8220;loser pays,&#8221; is not a new idea. It&#8217;s long existed in copyright law, it allows a court to award the winning party costs and fees in certain cases. In patent litigation, the <a title=\"Electronic Frontier Foundation\" href=\"https:\/\/www.techopedia.com\/definition\/2400\/electronic-frontier-foundation-eff\" target=\"_blank\" rel=\"homepage noopener noreferrer\">EFF<\/a> says this type of provision would help tilt the playing field slightly more in favor of the good guys. Fee shifting would empower innovators to fight back while discouraging trolls from threatening lawsuits to start.<\/p>\n<p>The EFF has set up a website <a title=\"EFF Defends Innovation\" href=\"https:\/\/defendinnovation.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">defendinnovation.org<\/a> to lead the battle against patent trolls and reform the <a title=\"United States Patent and Trademark Office\" href=\"http:\/\/www.uspto.gov\/\" target=\"_blank\" rel=\"homepage noopener noreferrer\">U.S. Patent Office<\/a>.<\/p>\n<p><strong><em>rb-<\/em><\/strong><\/p>\n<p><em><strong><a title=\"Voter apathy\" href=\"http:\/\/www.thegreenmarketoracle.com\/2011\/04\/social-media-is-mobilizing-youth-vote.html\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright\" style=\"border: 0px none;\" title=\"Voter apathy\" src=\"https:\/\/i0.wp.com\/3.bp.blogspot.com\/-lCNDAZXCoz8\/TbrpWkEY2PI\/AAAAAAAACuM\/xohZiK5VqDg\/s200\/social%2Bmedia%2Bcombating%2Bvoter%2Bapathy%2Bin%2BCanada.GIF?resize=165%2C210\" alt=\"Voter apathy\" width=\"165\" height=\"210\" \/><\/a>Sigh<\/strong> &#8211; Today is primary election day here in the U.S. and I just got back from voting and a whopping 417 people in my neighborhood had voted. There are almost 17,000 people 18 years or old. <\/em><\/p>\n<p><em>Voter apathy has everything to do with everything about where the US is today, including patent reform.
