Patent trolls have realized that taking on <strong>big companies with large legal teams is a risky<\/strong> prospect so they have started looking for softer targets. <em><a title=\"Ars Technica\" href=\"https:\/\/arstechnica.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Ars Technica<\/a><\/em> is <a title=\"Patent trolls want $1,000\u2014for using scanners\" href=\"http:\/\/arstechnica.com\/tech-policy\/2013\/01\/patent-trolls-want-1000-for-using-scanners\/\" target=\"_blank\" rel=\"noopener noreferrer\">reporting<\/a> the case of Steven Vicinanza and <a title=\"Bluewave\" href=\"https:\/\/web.archive.org\/web\/20221012160220\/http:\/\/www.bluewave-computing.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">BlueWave<\/a>, who received a letter ordering him to <strong>pay $1,000 per employee for a license for some &#8220;distributed computer architecture&#8221; <a title=\"Patent\" href=\"http:\/\/en.wikipedia.org\/wiki\/Patent\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">patents<\/a><\/strong>.<\/p>\n<p><a href=\"http:\/\/www.bizjournals.com\/philadelphia\/news\/2011\/09\/01\/sap-motion-to-have-13b-verdict-throw.html\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-100321 \" title=\"demanding money with legal menaces\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/Hands_grip_money.jpg?resize=55%2C84&#038;ssl=1\" alt=\"demanding money with legal menaces\" width=\"55\" height=\"84\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/Hands_grip_money.jpg?resize=99%2C150&amp;ssl=1 99w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/Hands_grip_money.jpg?resize=49%2C75&amp;ssl=1 49w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/Hands_grip_money.jpg?w=150&amp;ssl=1 150w\" sizes=\"auto, (max-width: 55px) 100vw, 55px\" \/><\/a>The blog says the troll in question,\u00a0&#8220;Project Paperless LLC.&#8221; claims to have a patent covering the ability to <strong>scan documents to e-mail<\/strong> and was demanding money with legal menaces. If BlueWave paid, the troll would have collected $130,000. BlueWave was not the only company the troll went after. Lots of other small and medium companies were being hit.<\/p>\n<p>Steven Hill, a partner at Hill, Kertscher &amp; Wharton, an Atlanta law firm represented Project Paperless. The attorney told Mr. Vicinanza that <strong>if you hook up a scanner and e-mail a PDF document the company&#8217;s patent covers that process<\/strong>. In other words, any company that used office equipment would have to pay up.<\/p>\n<p><a href=\"http:\/\/www.geekosystem.com\/courts-fin-patent-troll\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-100323 \" title=\"fight and beat the troll in court\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/gavel-e1565657291564-148x150.jpg?resize=88%2C89&#038;ssl=1\" alt=\"fight and beat the troll in court\" width=\"88\" height=\"89\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/gavel-e1565657291564.jpg?resize=148%2C150&amp;ssl=1 148w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/gavel-e1565657291564.jpg?resize=75%2C75&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/gavel-e1565657291564.jpg?w=363&amp;ssl=1 363w\" sizes=\"auto, (max-width: 88px) 100vw, 88px\" \/><\/a>In this case, Mr. Vicinanza decided to f<strong>ight and beat the troll in court<\/strong>. Despite the victory, <em>TechEye<\/em> says Project Paperless patents claims are continuing to appear. The troll claims were passed to a <strong>network of shell companies<\/strong>. <em>Ars<\/em> found that the patent threats are going out under a<strong>t least ten differently named LLCs<\/strong>.<\/p>\n<p>These outfits are sending out hundreds of copies of the same demand letter to small businesses from New Hampshire to Minnesota. The article says the troll&#8217;s royalty demands range from $<strong>900 to $1,200 per employee<\/strong>.<\/p>\n<p><em>Ars Technica<\/em> reports that Project Paperless has four patents and one patent application it asserts, all linked to an inventor named <strong>Laurence C. Klein<\/strong>. \u201c<em>It was a lot of what I\u2019d call gobbledygook<\/em>,\u201d said BlueWave&#8217;s Vicinanza. \u201c<em>Just jargon and terms strung together\u2014it\u2019s really literally nonsensical.<\/em>\u201d<\/p>\n<p><em><a href=\"https:\/\/web.archive.org\/web\/20150923214511\/https:\/\/www.nerdwallet.com\/blog\/nerdscholar\/2012\/mba-pros-cons\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-100326 \" title=\"t was a lot of what I\u2019d call gobbledygook\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/confused4-e1565657395485-150x101.jpg?resize=134%2C90&#038;ssl=1\" alt=\"t was a lot of what I\u2019d call gobbledygook\" width=\"134\" height=\"90\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/confused4-e1565657395485.jpg?resize=150%2C101&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/confused4-e1565657395485.jpg?resize=75%2C51&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/confused4-e1565657395485.jpg?w=363&amp;ssl=1 363w\" sizes=\"auto, (max-width: 134px) 100vw, 134px\" \/><\/a>Ars<\/em> provides links to the asserted patents, numbers <a title=\"Patent US 6185590\" href=\"http:\/\/www.google.com\/patents\/US6185590\" target=\"_blank\" rel=\"noopener noreferrer\">6,185,590<\/a>, <a title=\"Patent 6771381\" href=\"http:\/\/www.google.com\/patents\/US6771381\" target=\"_blank\" rel=\"noopener noreferrer\">6,771,381<\/a>, <a title=\"Patent 7477410\" href=\"http:\/\/www.google.com\/patents\/US7477410\" target=\"_blank\" rel=\"noopener noreferrer\">7,477,410 <\/a>and <a title=\"Patent 7986426\" href=\"http:\/\/www.google.com\/patents\/US7986426\" target=\"_blank\" rel=\"noopener noreferrer\">7,986,426<\/a>. AdzPro also notes it has an additional patent application filed in July 2011 that hasn\u2019t yet resulted in a patent. <em>Ars<\/em> states that the patents may have been useless from a technologist\u2019s perspective, but f<strong>ighting them off in court would be no small matter<\/strong>. The problem is that it often costs more in legal costs for small businesses to fight the trolls than it does to pay up and make them go away.<\/p>\n<p>Mr. Vicinanza spent $5,000 on a <a title=\"Prior art\" href=\"http:\/\/en.wikipedia.org\/wiki\/Prior_art\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">prior art search<\/a> and sent the results to the Project Paperless lawyers. He filed a third-party complaint against four of the companies that actually made the scanners, <a title=\"Xerox\" href=\"http:\/\/www.xerox.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Xerox<\/a> (<a title=\"NYSE | XRX\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-XRX\/\" target=\"_blank\" rel=\"noopener noreferrer\">XRX<\/a>) <a title=\"Canon\" href=\"http:\/\/www.canon.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Canon<\/a> (<a title=\"NYSE : CAJ\" href=\"https:\/\/www.nyse.com\/quote\/XNYS:CAJ\" target=\"_blank\" rel=\"noopener noreferrer\">CAJ<\/a>), <a title=\"HP\" href=\"http:\/\/www.hp.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">HP<\/a> (<a title=\"NYSE : HPQ\" href=\"https:\/\/www.nyse.com\/quote\/XNYS:HPQ\" target=\"_blank\" rel=\"noopener noreferrer\">HPQ<\/a>), and <a title=\"Brother\" href=\"http:\/\/www.brother-usa.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Brother<\/a> (<a title=\"Brother Industries ltd\" href=\"https:\/\/www.tradingview.com\/symbols\/TSE-6448\/\" target=\"_blank\" rel=\"noopener noreferrer\">6448<\/a>). That could have compelled the manufacturers to get involved in the case.<\/p>\n<p>In the end, Hill dropped its lawsuit against BlueWave and went away and the <strong>case never came to court<\/strong>. However, <em>Ars<\/em> points out a detailed website called \u201c<a title=\"Stop Project Paperless\" href=\"http:\/\/stop-project-paperless.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Stop Project Paperless<\/a>,\u201d with <a title=\"Stop Project Paperless\" href=\"https:\/\/web.archive.org\/web\/20180305182355\/http:\/\/stop-project-paperless.com\/the-patents\/\" target=\"_blank\" rel=\"noopener noreferrer\">information<\/a> about the patents and <a title=\"Stop Project Paperless\" href=\"https:\/\/web.archive.org\/web\/20211122215331\/http:\/\/stop-project-paperless.com\/hill-kertscher-wharton\/\" target=\"_blank\" rel=\"noopener noreferrer\">links<\/a> to the Hill, Kertscher, and Wharton law firm.<\/p>\n<p><em><a href=\"http:\/\/www.macobserver.com\/tmo\/article\/samsung_shows_courtroom_to_witnesses_breaks_court_rules\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-100328\" title=\"case never came to court\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/samsungcourtvisit-e1565657457127-150x107.jpg?resize=140%2C100&#038;ssl=1\" alt=\"case never came to court\" width=\"140\" height=\"100\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/samsungcourtvisit-e1565657457127.jpg?resize=150%2C107&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/samsungcourtvisit-e1565657457127.jpg?resize=75%2C53&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/samsungcourtvisit-e1565657457127.jpg?w=529&amp;ssl=1 529w\" sizes=\"auto, (max-width: 140px) 100vw, 140px\" \/><\/a>TechEye<\/em> concludes that if a firm wants to make a lot of money from a dubious patent, <strong>it is better to sue users than the companies which make products that use it.<\/strong> If Apple wanted to kill off Samsung&#8217;s business all it would have to do is sue every Android user. Most of them would never go to court and pay whatever Apple demands. That particular scenario is unlikely, but it does show where the antics of patent trolls are headed.<\/p>\n<p><strong><em>rb-<\/em><\/strong><\/p>\n<p><em>The politicians tried to work on the problem with the <a title=\"SHEILD Act\" href=\"https:\/\/web.archive.org\/web\/20130903113804\/https:\/\/www.eff.org\/sites\/default\/files\/SHIELD_ACT_0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">SHIELD Act<\/a> which I covered <a title=\"Anti-Troll Bill Introduced\" href=\"http:\/\/wp.me\/p2wgaW-4TN\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>, but that apparently went nowhere.
