{"id":2675,"date":"2010-05-16T22:26:07","date_gmt":"2010-05-17T02:26:07","guid":{"rendered":"http:\/\/rbachnet.wwwmi3-ss40.a2hosted.com\/?p=2675"},"modified":"2024-05-22T20:04:54","modified_gmt":"2024-05-23T00:04:54","slug":"whos-in-charge-here","status":"publish","type":"post","link":"https:\/\/rbach.net\/index.php\/whos-in-charge-here\/","title":{"rendered":"Who&#8217;s in Charge Here?"},"content":{"rendered":"<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-110756\" title=\"Who's in Charge Here?\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/supreme_court-1.jpg?resize=90%2C74&#038;ssl=1\" alt=\"Who's in Charge Here?\" width=\"90\" height=\"74\" \/>Apparently, the justices in the <strong>U.S. Supreme court don&#8217;t use much technology<\/strong>. <em><a href=\"https:\/\/web.archive.org\/web\/20200919120415\/https:\/\/lawyersusaonline.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">LawyersUSA<\/a><\/em> <a href=\"https:\/\/web.archive.org\/web\/20191008025918\/https:\/\/lawyersusaonline.com\/dcdicta\/2010\/04\/19\/technical-difficulties-at-the-supreme-court-2\/\" target=\"_blank\" rel=\"noopener noreferrer\">reports<\/a> that during oral arguments in the case City of Ontario v. Quon, which considers whether police officers had an expectation of privacy in personal (and sexually explicit) text messages sent on pagers issued to them by the city, the justices of the Supreme Court at times seemed to <strong>struggle with the technology involved.<\/strong><\/p>\n<p>Among the technical difficulties reported included Chief Justice John G. Roberts, Jr. &#8211; who is known to write out his opinions in longhand with pen and paper instead of a computer &#8211; asked <strong>what the difference was \u201c<em>between email and a pager<\/em>?\u201d<\/strong><\/p>\n<p>Justice Anthony Kennedy asked what would happen if a text message was sent to an officer at the same time he was sending one to someone else. \u201c<em>Does it say: \u2018Your call is important to us, and we will get back to you?<\/em>\u2019\u201d Kennedy asked.<\/p>\n<p>Justice Antonin Scalia wrangled a bit with the idea of a service provider. \u201c<em>You mean (the text) doesn\u2019t go right to me?<\/em>\u201d he asked. Then he asked whether they can be printed out in hard copy. \u201c<em>Could Quon print these spicy little conversations and send them to his buddies?<\/em>\u201d Scalia asked.<\/p>\n<p><strong><em>rb-<\/em><\/strong><\/p>\n<p><em>While I&#8217;m no lawyer, I have a passing knowledge of how courts work (and don&#8217;t work) to frame decisions I make.
