They confirmed (4-22-09) that the <strong>patent cases<\/strong> heard in the <a href=\"https:\/\/www.txed.uscourts.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\">Eastern District Court of <strong>Texas<\/strong><\/a> as concluded &#8220;successfully.&#8221; CSIRO sued most of the tech world over its claim of inventing the technology behind <strong>Wi-Fi<\/strong> Wireless Local Area Networks (<strong>WLANs<\/strong>).<\/p>\n<p><a href=\"http:\/\/web.archive.org\/web\/20130817081804\/http:\/\/www.ict.csiro.au\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-101994 size-full\" title=\"Australia's Commonwealth Scientific and Industrial Research Organization\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/csiro_logo.png?resize=66%2C80&#038;ssl=1\" alt=\"Australia's Commonwealth Scientific and Industrial Research Organization\" width=\"66\" height=\"80\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/csiro_logo.png?w=66&amp;ssl=1 66w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/csiro_logo.png?resize=62%2C75&amp;ssl=1 62w\" sizes=\"auto, (max-width: 66px) 100vw, 66px\" \/><\/a>CSIRO claims to have patented core elements of the technology used in <strong>802.11a and 802.11g<\/strong> wireless devices. &#8220;<em>CSIRO has negotiated settlement with each of the 14 companies involved in four concurrent litigation cases,<\/em>&#8221; the agency said in a statement. &#8220;<em>The commercial terms of the settlements with these companies will remain confidential.<\/em>&#8221;<\/p>\n<h3>Wi-Fi patent claim<\/h3>\n<p>The CSIRO first applied for the US patent in 1993. It was awarded <a href=\"https:\/\/web.archive.org\/web\/20190622065514\/http:\/\/patft.uspto.gov\/netacgi\/nph-Parser?Sect1=PTO1&amp;Sect2=HITOFF&amp;d=PALL&amp;p=1&amp;u=\/netahtml\/PTO\/srchnum.htm&amp;r=1&amp;f=G&amp;l=50&amp;s1=5,487,069.PN.&amp;OS=PN\/5,487,069&amp;RS=PN\/5,487,069\" target=\"_blank\" rel=\"noopener noreferrer\">US patent number 5,487,069<\/a>, entitled &#8220;Wireless LAN&#8221; on 23 January 1996. The patent describes a &#8220;peer-to-peer wireless LAN&#8221; that can operate in the kind of multi-path environment created by radio echoes in typical office buildings. It includes three ways to get high-speed transmission despite the hostile conditions in an office environment. First, they describe transmitting over a relatively large number of parallel sub-channels within the available bandwidth so that each channel has a low bit rate. Second, the patent describes transmitting data in small packets with forward error correction (FEC) and using interleaving. They claimed to have, &#8220;<em>offered licenses on reasonable and non-discriminatory terms to major suppliers as soon as they started selling devices which used the CSIRO technology.<\/em>&#8221;<\/p>\n<p>However, troubles began following the <strong><a href=\"http:\/\/www.cisco.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Cisco<\/a><\/strong> (<a href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-CSCO\/\" target=\"_blank\" rel=\"noopener noreferrer\">CSCO<\/a>) acquisition of <a href=\"https:\/\/web.archive.org\/web\/20100214152649\/http:\/\/www.zdnet.com.au:80\/news\/communications\/soa\/HP-settles-with-CSIRO\/0,130061791,339295788,00.htm?\" target=\"_blank\" rel=\"noopener noreferrer\">Radiata<\/a> from <a title=\"Macquarie University\" href=\"http:\/\/maps.google.com\/maps?ll=-33.7752777778,151.113888889&amp;spn=0.01,0.01&amp;q=-33.7752777778,151.113888889 (Macquarie%20University)&amp;t=h\" target=\"_blank\" rel=\"geolocation noopener noreferrer\">Macquarie University<\/a>. The university had carried out for the purpose of commercializing CSIRO&#8217;s technology. Now CSIRO claims the work forms a key part of commonly used Wi-Fi products<\/p>\n<p>The CSIRO filed Wi-Fi patent infringement suits against <a href=\"https:\/\/web.archive.org\/web\/20110221210101\/http:\/\/www.3com.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">3Com<\/a>, <a href=\"https:\/\/www.accton.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Accton<\/a> (<a title=\"TAIEX:2345\" href=\"https:\/\/www.marketwatch.com\/investing\/stock\/2345\/profile?countrycode=tw\" target=\"_blank\" rel=\"noopener noreferrer\">2345<\/a>), <a title=\"usa.asus.com\" href=\"https:\/\/www.asus.com\/us\/\" target=\"_blank\" rel=\"noopener noreferrer\">ASUS<\/a> (<a title=\"TT : 2357\" href=\"https:\/\/www.tradingview.com\/symbols\/TWSE-2357\/\" target=\"_blank\" rel=\"noopener noreferrer\">2357<\/a>), <a title=\"Belkin\" href=\"http:\/\/www.belkin.com\" target=\"_blank\" rel=\"noopener noreferrer\">Belkin<\/a>, <a title=\"D-Link\" href=\"http:\/\/www.dlink.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">D-Link<\/a> (<a href=\"http:\/\/www.google.com\/finance?q=TPE:2332\" target=\"_blank\" rel=\"noopener noreferrer\">DLINK<\/a>), <a href=\"http:\/\/www.fujitsu.com\/us\/\" target=\"_blank\" rel=\"noopener noreferrer\">Fujitsu<\/a> (<a title=\"TYO: JP:6702\" href=\"http:\/\/www.marketwatch.com\/investing\/stock\/6702?countrycode=jp\" target=\"_blank\" rel=\"noopener noreferrer\">6702<\/a>), <a href=\"http:\/\/www.Marvell.com\" target=\"_blank\" rel=\"noopener noreferrer\">Marvell<\/a> (<a title=\"NASDAQ: MRVL\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-MRVL\/\" target=\"_blank\" rel=\"noopener noreferrer\">MRVL<\/a>), (manufacturers of\u00a0<a title=\"Apple Computers\" href=\"http:\/\/www.apple.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Apple&#8217;s<\/a> (<a title=\"NASDAQ : AAPL\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-AAPL\/\" target=\"_blank\" rel=\"noopener noreferrer\">AAPL<\/a>) <a href=\"http:\/\/en.wikipedia.org\/wiki\/IPod\" target=\"_blank\" rel=\"noopener noreferrer\">iPod<\/a>), <a title=\"www.nintendo.com\" href=\"http:\/\/www.nintendo.com\/?country=US&amp;lang=en\" target=\"_blank\" rel=\"noopener noreferrer\">Nintendo<\/a> (<a title=\"TYO : 7978\" href=\"http:\/\/www.bloomberg.com\/apps\/quote?ticker=7974:JP\" target=\"_blank\" rel=\"noopener noreferrer\">7978)<\/a>, <a title=\"SMC\" href=\"https:\/\/www.smcworld.com\/en-jp\/\" target=\"_blank\" rel=\"noopener noreferrer\">SMC<\/a> and <a href=\"https:\/\/web.archive.org\/web\/20160318064944\/http:\/\/us.toshiba.com:80\/computers\/laptops\" target=\"_blank\" rel=\"noopener noreferrer\">Toshiba<\/a> (<a href=\"https:\/\/www.bbc.co.uk\/news\/business-66874016\" target=\"_blank\" rel=\"noopener noreferrer\">TOSBF<\/a>). Several large technology vendors bit back &#8211; with \u00a0Apple, <a href=\"http:\/\/www.dell.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Dell<\/a> (<a href=\"https:\/\/www.tradingview.com\/symbols\/NYSE-DELL\/\" target=\"_blank\" rel=\"noopener noreferrer\">DELL<\/a>), <a title=\"HP\" href=\"http:\/\/www.hp.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">HP<\/a> (<a title=\"NYSE : HPQ\" href=\"https:\/\/www.nyse.com\/quote\/XNYS:HPQ\" target=\"_blank\" rel=\"noopener noreferrer\">HPQ<\/a>), <a title=\"Intel\" href=\"https:\/\/www.intel.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Intel<\/a> (<a title=\"HASDAQ : INTC\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-INTC\/\" target=\"_blank\" rel=\"noopener noreferrer\">INTC<\/a>),\u00a0<a title=\"Microsoft\" href=\"http:\/\/www.microsoft.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Microsoft<\/a> (<a title=\"NASDAQ | MSFT\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-MSFT\/\" target=\"_blank\" rel=\"noopener noreferrer\">MSFT<\/a>), and <a href=\"http:\/\/www.Netgear.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Netgear<\/a> (<a title=\"NASDAQ: NTGR\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-NTGR\/\" target=\"_blank\" rel=\"noopener noreferrer\">NTGR<\/a>) bringing cases against CSIRO in trying to have the patent invalidated.<\/p>\n<p>In June 2007, the <strong>CSIRO won a case in the U.S. Federal Court<\/strong> against Japanese manufacturer <a href=\"https:\/\/www.buffalotech.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Buffalo Technologies<\/a>. This win is the basis the firm has used to <strong>demand royalties<\/strong> from a broader set of manufacturers that market <a href=\"http:\/\/www.wi-fi.org\" target=\"_blank\" rel=\"noopener noreferrer\">Wi-Fi<\/a> equipment.<\/p>\n<p>As the case has played out in the last few weeks in and out of the Texas court, CSIRO struck individual deals with its adversary&#8217;s including; <a title=\"Dell\" href=\"https:\/\/www.investopedia.com\/ask\/answers\/052015\/who-are-dells-main-competitors.asp\" target=\"_blank\" rel=\"noopener noreferrer\">Dell<\/a>, <a title=\"Fujitsu\" href=\"https:\/\/searchconvergedinfrastructure.techtarget.com\/definition\/Fujitsu-Ltd\" target=\"_blank\" rel=\"noopener noreferrer\">Fujitsu<\/a>, <a title=\"HP\" href=\"https:\/\/en.wikipedia.org\/wiki\/Hewlett-Packard\" target=\"_blank\" rel=\"noopener noreferrer\">HP<\/a>, <a title=\"Intel\" href=\"https:\/\/www.marketbeat.com\/stocks\/NASDAQ\/INTC\/\" target=\"_blank\" rel=\"noopener noreferrer\">Intel<\/a>, and <a title=\"Microsoft\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-MSFT\/\" target=\"_blank\" rel=\"noopener noreferrer\">Microsoft<\/a><\/p>\n<p>HP was the first to settle on 04-02-09. CSIRO spokesperson Huw Morgan said, &#8220;<em>CSIRO can confirm that a settlement has been reached with Hewlett-Packard Company in relation to the wireless patent case.<\/em>&#8221; Mr. Morgan continued\u00a0 in the <em><a href=\"http:\/\/www.smh.com.au\/news\/technology\/biztech\/csiro-cashes-in-on-patent-claim\/2009\/04\/01\/1238261630683.html\" target=\"_blank\" rel=\"noopener noreferrer\">Sydney Morning Herald<\/a><\/em>, &#8220;<em>There will be no further comment at this time due to confidentiality and ongoing litigation.<\/em>&#8221;<\/p>\n<p><a href=\"https:\/\/www.fujitsu.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-102002 size-full\" title=\"Fujitsu logo\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/fujitsu_logo.jpg?resize=80%2C40&#038;ssl=1\" alt=\"Fujitsu logo\" width=\"80\" height=\"40\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/fujitsu_logo.jpg?w=80&amp;ssl=1 80w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/fujitsu_logo.jpg?resize=75%2C38&amp;ssl=1 75w\" sizes=\"auto, (max-width: 80px) 100vw, 80px\" \/><\/a>Fujitsu Computer Systems Corp. was dismissed by the Court with prejudice in the first court-approved settlement to emerge in the case on April 8. The terms of the settlement remain confidential.<\/p>\n<p>PC manufacturer Asus and Microsoft separately settled their lawsuits with the CSIRO on 04-14-09 terms of the settlement were not disclosed. CSIRO had accused Microsoft of wrongfully using its patent. Microsoft was seeking a ruling of non-infringement for the wireless technology included in the <a href=\"http:\/\/www.xbox.com\" target=\"_blank\" rel=\"noopener noreferrer\">Xbox<\/a> video-game system.<\/p>\n<p><a href=\"\/\/www.microsoft.com\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-102004 size-thumbnail\" title=\"Microsoft logo\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/microsoft_logo_old.jpg?resize=75%2C12&#038;ssl=1\" alt=\"Microsoft logo\" width=\"75\" height=\"12\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/microsoft_logo_old.jpg?resize=75%2C12&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/microsoft_logo_old.jpg?resize=150%2C25&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/microsoft_logo_old.jpg?w=500&amp;ssl=1 500w\" sizes=\"auto, (max-width: 75px) 100vw, 75px\" \/><\/a>Intel and Dell also settled on 04-19-09 for undisclosed and confidential terms.<\/p>\n<p>Accton Technology Corp., SMC Networks, Belkin Corp. and Belkin International, Inc., D-Link Systems, Inc., Netgear, Inc., Nintendo of America, Inc., Toshiba America Information Systems, Inc., and 3Com Corp., announced on 4-20-09 that they had reached a settlement with CSIRO.<\/p>\n<p><a href=\"http:\/\/www.cisco.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Cisco<\/a> and its <a href=\"http:\/\/www.linksys.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Linksys<\/a> division aren&#8217;t on CSIRO&#8217;s list. Cisco <a href=\"http:\/\/wifinetnews.com\/archives\/2009\/04\/csiro_presses_on_in_wi-fi_patent_battle.html\" target=\"_blank\" rel=\"noopener noreferrer\">agreed to patent terms<\/a> when it acquired an Australian network authentication firm a few years ago. Apple dropped out in December 2006.<\/p>\n<p>Dr. Alex Zelinsky, director of the <a href=\"http:\/\/web.archive.org\/web\/20130817081804\/http:\/\/www.ict.csiro.au\/\" target=\"_blank\" rel=\"noopener noreferrer\">CSIRO ICT Center<\/a> confirmed that all CSIRO opponents had chosen to settle the wireless case. CSIRO deputy chief of operations Mike Whelan said that the terms of the settlement would remain strictly confidential.
