Some in DC are attempting to <strong>rewrite the broken patent system<\/strong>. Under the current patent laws, what the author calls the struggling old guard firms can exploit the patent system to abuse monopolies over basic software concepts from decades ago. The result has been to smother start-ups and weigh down vibrant parts of the tech economy with <strong>frivolous lawsuits<\/strong>; <strong>lawyers get fat<\/strong> at the expense of those who are building real businesses.<\/p>\n<p><a href=\"http:\/\/web.archive.org\/web\/20120708033351\/http:\/\/tarheelred.com:80\/2012\/02\/01\/capitalism-and-greed\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-102086\" title=\"Microsoft and IBM gutted a key House bill\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/greed.jpg?resize=100%2C122&#038;ssl=1\" alt=\"Microsoft and IBM gutted a key House bill\" width=\"100\" height=\"122\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/greed.jpg?w=123&amp;ssl=1 123w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/greed.jpg?resize=62%2C75&amp;ssl=1 62w\" sizes=\"auto, (max-width: 100px) 100vw, 100px\" \/><\/a>The latest push by Congress to fix the software patent problem suffered a setback after <strong>Congress allowed Microsoft and <a title=\"International Business Machines (IBM)\" href=\"http:\/\/web.archive.org\/web\/20140418191521\/http:\/\/www.wikinvest.com\/stock\/International_Business_Machines_(IBM)\" target=\"_blank\" rel=\"noopener wikinvest noreferrer\">IBM<\/a> to gut a key House bill<\/strong> that would have made it easier for victims to push back. <em>TechEye<\/em> explains that the &#8220;covered business method&#8221; (CBM) program drew the ire of\u00a0<a title=\"Microsoft\" href=\"http:\/\/www.microsoft.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Microsoft<\/a> (<a title=\"NASDAQ | MSFT\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-MSFT\/\" target=\"_blank\" rel=\"noopener noreferrer\">MSFT<\/a>) and <a title=\"IBM\" href=\"http:\/\/www.ibm.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">IBM<\/a> (<a title=\"NYSE : IBM\" href=\"https:\/\/www.nyse.com\/quote\/XNYS:IBM\" target=\"_blank\" rel=\"noopener noreferrer\">IBM<\/a>). The changes proposed would have <strong>sped up the method for the Patent Office to get rid of low-quality <a title=\"Software patent\" href=\"http:\/\/en.wikipedia.org\/wiki\/Software_patent\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">software patents<\/a><\/strong>. Under the reformed program, MSFT and IBM could not sue someone until the <a title=\"US Patent Office\" href=\"http:\/\/www.uspto.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\">Patent Office<\/a> considered <strong>if the patent was viable<\/strong>. <em>TechEye<\/em> reports that <strong>IBM flexed its political muscle (<em>cash?<\/em>)<\/strong> to stop the effort to expand the CBM program. An IBM spokesperson said that while &#8220;<em>we support what Mr. Goodlatte&#8217;s trying to do on trolls, if the CBM is included, we&#8217;d be forced to oppose the bill.<\/em>&#8221;<\/p>\n<p>The upshot according to <em>GigaOM<\/em> is that for the second time in three years, the U.S. is poised to <strong>pass a<\/strong> law that will make <strong>cosmetic changes<\/strong> to the patent system <strong>without addressing the root cause<\/strong> \u2014 garbage software patents \u2014 that has made the system a mockery and a byword for <strong>legalized extortion<\/strong>.<\/p>\n<p><a href=\"https:\/\/www.uspto.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-102088 size-thumbnail\" title=\"Patent Office\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/uspto_logo-1.jpg?resize=75%2C75&#038;ssl=1\" alt=\"Patent Office\" width=\"75\" height=\"75\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/uspto_logo-1.jpg?resize=75%2C75&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/uspto_logo-1.jpg?resize=150%2C150&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/uspto_logo-1.jpg?w=255&amp;ssl=1 255w\" sizes=\"auto, (max-width: 75px) 100vw, 75px\" \/><\/a>The article claims that reformers shouldn&#8217;t despair quite yet. <em>GigaOM<\/em> cites sources close to the legislative process that think real reform could still happen if powerful senators prevail and if opponents outgun Microsoft and its allies in the <strong>grubby money and lobbyist game<\/strong>. <em>GigaOM<\/em> lays out how the reform was de-railed.<\/p>\n<h3>Money Talks in the House<\/h3>\n<p>The chair of the <a title=\"United States House Committee on the Judiciary\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_House_Committee_on_the_Judiciary\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">House Judiciary Committee<\/a>, Rep. <a title=\"Bob Goodlatte\" href=\"http:\/\/en.wikipedia.org\/wiki\/Bob_Goodlatte\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">Bob Goodlatte<\/a> (R. Va.), was scheduled to bring his much-touted patent bill for a vote. The bill arrived on schedule \u2014 but it was a neutered version.<\/p>\n<p><a href=\"https:\/\/web.archive.org\/web\/20160423144736\/http:\/\/pinellasnewsboy.com\/2009\/05\/04\/tax-credit-money-up-front-for-your-pinellas-county-home\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-102090 size-thumbnail\" title=\"Fat cat, money\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/money-bag-e1566952918319-52x75.jpg?resize=52%2C75&#038;ssl=1\" alt=\"Fat cat, money\" width=\"52\" height=\"75\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/money-bag-e1566952918319.jpg?resize=52%2C75&amp;ssl=1 52w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/money-bag-e1566952918319.jpg?resize=103%2C150&amp;ssl=1 103w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/money-bag-e1566952918319.jpg?w=553&amp;ssl=1 553w\" sizes=\"auto, (max-width: 52px) 100vw, 52px\" \/><\/a>A key provision, which would have provided a <strong>way to challenge software patents at the Patent Office, is no longer in the bill<\/strong>, which <a title=\"Patent Troll\" href=\"https:\/\/www.eff.org\/issues\/resources-patent-troll-victims\" target=\"_blank\" rel=\"noopener noreferrer\">Fat cat<\/a> money passed 33-5 vote by the committee. The change is significant, the author says because it means <strong>victims of patent bullies must still pay millions to challenge the patents<\/strong> in federal court or, as most do, simply swallow hard and pay a licensing fee.<\/p>\n<p>Mr. Goodlatte\u2019s decision to drop the provision is a <strong>victory for <a title=\"IBM\" href=\"https:\/\/www.tradingview.com\/symbols\/NYSE-IBM\/\" target=\"_blank\" rel=\"noopener noreferrer\">IBM<\/a> and <a title=\"Microsoft\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-MSFT\/\" target=\"_blank\" rel=\"noopener noreferrer\">Microsoft<\/a><\/strong>, which have stacks of <strong>old software patents<\/strong> that provide licensing revenue even as their product lines sputter. It\u2019s also a victory for trolls, which the article says are shell companies backed by <strong>private equity firms and lawyers that use patents<\/strong> (often obtained from Microsoft and others under a \u201c<a title=\"Privateering: Patent Holding Companies Unleash Patent Portfolios\" href=\"http:\/\/www.ipwatchdog.com\/2013\/02\/11\/privateering-patent-holding-companies-unleash-patent-portfolios\/id=35287\/\" target=\"_blank\" rel=\"noopener noreferrer\">privateering<\/a>\u201d arrangement) to wage ruinous legal war against everyone from <a title=\"Martha Stewart files lawsuit against Lodsys following patent infringement accusations\" href=\"http:\/\/www.theverge.com\/2013\/9\/26\/4772100\/martha-stewart-files-lawsuit-against-patent-troll-lodsys\" target=\"_blank\" rel=\"noopener noreferrer\">Martha Stewart<\/a> to individual <a title=\"Patent Trolls Going After Users\" href=\"https:\/\/wp.me\/p2wgaW-5SZ\" target=\"_blank\" rel=\"noopener noreferrer\">users<\/a>. The account was confirmed by a source close to <a title=\"Google\" href=\"https:\/\/www.google.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Google<\/a> (<a title=\"NASDAQ : GOOG\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-GOOG\/\" target=\"_blank\" rel=\"noopener noreferrer\">GOOG<\/a>) and other groups that pushed for the provision to challenge software patents.<\/p>\n<p>\u201c<em>They outspent the living shit out of us,<\/em>\u201d said the source, who did not want to be named. He said that the companies spent heavily to <strong>lobby Democrats on the Committee and freshman Republicans<\/strong>, forcing Mr. Goodlatte to remove the provision rather than seeing it voted down at this stage.<\/p>\n<p>A source with a lobbying group allied with Microsoft said the software giant\u2019s role had been overstated, and that the change in the bill was less about money than it was about \u201cshoe leather\u201d lobbying.<\/p>\n<h3>Patent reform in the Senate<\/h3>\n<p><a title=\"Electronic Frontier Foundation \" href=\"https:\/\/www.eff.org\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright\" style=\"border: 0px none; margin-left: 2px; margin-right: 2px;\" title=\"Electronic Frontier Foundation \" src=\"https:\/\/i0.wp.com\/www.eff.org\/files\/EFF-logo-trans.gif?resize=108%2C74&#038;ssl=1\" alt=\"Electronic Frontier Foundation \" width=\"108\" height=\"74\" \/><\/a>\u201c<em>If we had a quarter of the people who opposed <a title=\"What Is SOPA?\" href=\"https:\/\/web.archive.org\/web\/20181113155100\/https:\/\/gizmodo.com\/5877000\/what-is-sopa\" target=\"_blank\" rel=\"noopener noreferrer\">SOPA<\/a> supporting this anti-patent troll law, we\u2019d win,<\/em>\u201d <a title=\"Chuck Schumer\" href=\"http:\/\/schumer.senate.gov\/\" target=\"_blank\" rel=\"homepage noopener noreferrer\">Sen. Chuck Schumer<\/a> (D-NY) told the author. Mr. Schumer was joined by the <strong><a title=\"EFF\" href=\"https:\/\/www.eff.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">Electronic Frontier Foundation<\/a><\/strong>, to talk patent reform and his up his bill to take on trolls, which he said are \u201cpreying on New York\u2019s technology industry.\u201d<\/p>\n<p>Mr. Schumer is pushing a bill that includes the key provision about software patents that was stripped from the House bill. Schumer\u2019s support is significant, not only because he carries clout in the Senate, but because he succeeded in including a similar provision aimed at <strong>frivolous financial services patents<\/strong> in the <a title=\"Leahy-Smith America Invents Act\" href=\"http:\/\/en.wikipedia.org\/wiki\/Leahy-Smith_America_Invents_Act\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">America Invents Act<\/a> of 2011.<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-102102\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/lobbying-1.gif?resize=107%2C100&#038;ssl=1\" alt=\"\" width=\"107\" height=\"100\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/lobbying-1.gif?resize=150%2C140&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/lobbying-1.gif?resize=75%2C70&amp;ssl=1 75w\" sizes=\"auto, (max-width: 107px) 100vw, 107px\" \/><strong>Other patent reform bills<\/strong> are circulating in the Senate including similar bills from <a title=\"Patrick Leahy\" href=\"https:\/\/web.archive.org\/web\/20230103032641\/https:\/\/www.leahy.senate.gov\/\" target=\"_blank\" rel=\"homepage noopener noreferrer\">Sen. Patrick Leahy<\/a> (D-Va.) and <a title=\"John Cornyn\" href=\"http:\/\/www.cornyn.senate.gov\/\" target=\"_blank\" rel=\"homepage noopener noreferrer\">Sen. John Cornyn<\/a> (R-Tx.). According to the source tied to Google, Mr. Leahy has signaled that his bill is a \u201cChristmas tree,\u201d meaning other politicians can hang their preferred provisions atop it; the bill that will ultimately get a vote on the Senate floor will likely contain a provision to challenge software patents.<\/p>\n<p>Washington insiders said patent legislation is one of the few bipartisan initiatives available to members of Congress, who are eager to notch legislative achievements before the mid-term campaign season begins next summer. This means that the bills are expected to go to a full floor vote in the House and Senate by early 2014 and that a markup session on a final bill will take place in the spring \u2014 the only question is which version will prevail.<\/p>\n<h3>The endgame<\/h3>\n<p>\u201c<em>There\u2019s months to go till conference committee,<\/em>\u201d said the source close to the reform lobby, predicting that the balance of power will tilt towards the software patent reform camp, as Google and others ramp up lobbying efforts. The source tied to Microsoft, unsurprisingly, panned this prediction and declared that challenges to software patents are now a \u201cthird rail\u201d that most in Congress don\u2019t want to touch.<\/p>\n<p>The <strong>outcome will be determined in large part by money<\/strong>, and whether Google and the other companies that recognize the harm caused by software patents (<a title=\"Twitter\" href=\"https:\/\/twitter.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Twitter<\/a> (<a title=\"NYSE : TWTR\" href=\"https:\/\/www.tradingview.com\/symbols\/NYSE-TWTR\/\" target=\"_blank\" rel=\"noopener noreferrer\">TWTR<\/a>) is another) are willing to seize the chance at reform that is within their grasp.<\/p>\n<p>Today, attitudes have changed after a steady parade of patent horror stories: <strong>Boston University using a 1997 patent to sue Apple<\/strong> and seek an iPhone ban; a troll using a 1998 patent from a Holocaust foundation to <strong>shake down the New York Times<\/strong>; a troll lawyer who boasts he likes to \u201c<strong>go thug<\/strong>,\u201d and is pressing an extortion campaign against hundreds of companies.<\/p>\n<p><a href=\"http:\/\/www.forbes.com\/sites\/netapp\/2013\/06\/05\/obama-patent-troll-fight\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-102094 size-medium\" title=\"the patent system is out of hand\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/obama-patent-trolls.jpg?resize=150%2C113&#038;ssl=1\" alt=\"the patent system is out of hand\" width=\"150\" height=\"113\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/obama-patent-trolls.jpg?resize=150%2C113&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/obama-patent-trolls.jpg?resize=75%2C56&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/obama-patent-trolls.jpg?w=508&amp;ssl=1 508w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><\/a>All of this has led everyone from small app developers to <strong><a title=\"POTUS Declares War on Patent Trolls\" href=\"https:\/\/wp.me\/p2wgaW-cqX\" target=\"_blank\" rel=\"noopener noreferrer\">President Obama<\/a> to suggest the patent system is out of hand<\/strong>. After years of asking defendants to take it on faith that the system is working, it\u2019s now up to Microsoft and others to justify that their ancient software patents \u2014 which award 20-year monopolies in a fast-moving industry \u2014 do more good than harm.<\/p>\n<p><strong><em>\u00a0rb-<\/em><\/strong><\/p>\n<p><em>While I&#8217;m not a lawyer, this seems pretty messed up to me.
