The <a title=\"Federal Communications Commission\" href=\"https:\/\/www.fcc.gov\/\" target=\"_blank\" rel=\"homepage nofollow noopener noreferrer\">FCC<\/a> ruling said AT&amp;T should be awarded damages for being overcharged by two <a title=\"Michigan\" href=\"https:\/\/www.google.com\/maps\/@45.810172,-84.72882,3a,75y,54.4h,65.76t\/data=!3m5!1e1!3m3!1s_egRaIiZb9106vPgYWBxeg!2e0!3e5?hl=en-US\" target=\"_blank\" rel=\"noopener noreferrer\">Michigan-<\/a>based rural telcos for interstate access services. Now the FCC has to set how much money AT&amp;T should receive from <a title=\"East Lansing, MI\" href=\"https:\/\/www.google.com\/maps\/place\/East+Lansing,+MI\/@42.7342586,-84.5031403,10193m\/data=!3m1!1e3!4m2!3m1!1s0x8822e875eae5abf3:0x3b19b3f7117ca625\" target=\"_blank\" rel=\"noopener noreferrer\">East Lansing-<\/a>based\u00a0<a title=\"Great Lakes Comnet\" href=\"http:\/\/www.glcom.net\/network\/\" target=\"_blank\" rel=\"noopener noreferrer\">Great Lakes Comnet<\/a>\u00a0(GLC) and\u00a0<a title=\"Westphalia Telephone Company\" href=\"http:\/\/www.comlink.net\/residential-about\" target=\"_blank\" rel=\"noopener noreferrer\">Westphalia\u00a0Telephone Company<\/a> (WTC). The FCC wrote in its order, &#8220;<em>We agree with AT&amp;T.<\/em>&#8221;<\/p>\n<p>Initially, AT&amp;T asked for a $12 million refund and wants to avoid paying an extra $4.3 million that Westphalia and Great Lakes\u00a0claim the telco owes them. The author explains that the FCC argued that AT&amp;T was billed unlawfully because of\u00a0<a title=\"47 U.S. Code \u00a7 201 - Service and charges\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/47\/201\" target=\"_blank\" rel=\"noopener noreferrer\">Section 201(b)<\/a>\u00a0of the Communications Act. This is the part of Title II that says: &#8220;<em>All charges, practices, classifications, and regulations for and in connection with such communication service, shall be just and reasonable, and any such charge, practice, classification, or regulation that is unjust or unreasonable is declared to be unlawful.<\/em>&#8221;<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-105856 \" title=\"Verizon raised consumer phone rates to fund the broadband network they objected to\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/who-controls-the-web.jpg?resize=120%2C110&#038;ssl=1\" alt=\"Verizon raised consumer phone rates to fund the broadband network they objected to\" width=\"120\" height=\"110\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/who-controls-the-web.jpg?resize=150%2C137&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/who-controls-the-web.jpg?resize=75%2C68&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/who-controls-the-web.jpg?w=640&amp;ssl=1 640w\" sizes=\"auto, (max-width: 120px) 100vw, 120px\" \/>Ironically, during the run-up to the net neutrality decision, \u00a0AT&amp;T, <a title=\"Verizon\" href=\"http:\/\/www.verizon.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Verizon<\/a> (<a title=\"NASDAQ : VZ\" href=\"https:\/\/www.tradingview.com\/symbols\/NYSE-VZ\/\" target=\"_blank\" rel=\"noopener noreferrer\">VZ<\/a>), <a title=\"Comcast\" href=\"https:\/\/www.xfinity.com\/overview\" target=\"_blank\" rel=\"noopener noreferrer\">Comcast<\/a> (<a title=\"NASDAQ : CMCSA\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-CMCSA\/\" target=\"_blank\" rel=\"noopener noreferrer\">CMCSA)<\/a>, and other telcos claimed that regulation would hurt their profits, which seems like misinformation BS. The <em>FierceTelecom<\/em> article reports that\u00a0the FCC said that it won&#8217;t set specific price caps or tell service providers what they can charge for service, consumers can complain to the FCC if their provider is overcharging them for service.<\/p>\n<p><em>FierceTelecom <\/em>also points to an <a href=\"https:\/\/arstechnica.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Ars Technica<\/em><\/a> <a title=\"AT&amp;T is using the Title II rules it hates to get millions in refunds\" href=\"http:\/\/arstechnica.com\/business\/2015\/03\/att-is-using-the-title-ii-rules-it-hates-to-get-millions-in-refunds\/\" target=\"_blank\" rel=\"noopener noreferrer\">report<\/a>, that <a title=\"Verizon\" href=\"http:\/\/www.verizon.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Verizon<\/a> (<a title=\"NASDAQ : VZ\" href=\"https:\/\/www.tradingview.com\/symbols\/NYSE-VZ\/\" target=\"_blank\" rel=\"noopener noreferrer\">VZ<\/a>), another outspoken critic of applying Title II to broadband services, ironically used its common carrier status for POTS services to build its FiOS <a title=\"Fiber-to-the-Home (FTTH)\" href=\"https:\/\/web.archive.org\/web\/20180930234703\/http:\/\/www.wikinvest.com:80\/concept\/Fiber-to-the-Home_(FTTH)\" target=\"_blank\" rel=\"nofollow noopener wikinvest noreferrer\">fiber-to-the-home (FTTH)<\/a> network. Besides leveraging Title II to get access to utility poles and rights-of-way to string up fiber, Verizon raised consumer phone rates to fund the fiber build.<\/p>\n<p><strong><em>rb-<\/em><\/strong><\/p>\n<p><em>This could be written-off as unintended consequences or is it?
