{"id":7625,"date":"2011-05-28T17:12:15","date_gmt":"2011-05-28T21:12:15","guid":{"rendered":"http:\/\/rbach.net\/blog\/index.php\/"},"modified":"2022-12-30T16:10:02","modified_gmt":"2022-12-30T21:10:02","slug":"michigan-troopers-downloading-phone-data-without-warrants-2","status":"publish","type":"post","link":"https:\/\/rbach.net\/index.php\/michigan-troopers-downloading-phone-data-without-warrants-2\/","title":{"rendered":"Michigan Troopers Downloading Phone Data Without Warrants?"},"content":{"rendered":"<p><a href=\"http:\/\/www.mlive.com\/news\/flint\/index.ssf\/2011\/05\/michigan_house_passes_school_a.html\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"wp-image-7298 alignleft\" style=\"border: 0pt none;\" title=\"Michigan Troopers Downloading Phone Data Without Warrants?\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/2011\/04\/michigan-e1564337191458.png?resize=108%2C121&#038;ssl=1\" alt=\"\" width=\"108\" height=\"121\" \/><\/a>Think about this while you are driving around this Memorial Day weekend. &#8211; The <a title=\"American Civil Liberties Union\" href=\"http:\/\/www.aclu.org\/\" target=\"_blank\" rel=\"homepage noopener noreferrer\">American Civil Liberties Union<\/a> of Michigan claims that for several years now <a title=\"Michigan State Police\" href=\"https:\/\/www.michigan.gov\/msp\/\" target=\"_blank\" rel=\"homepage noopener noreferrer\">Michigan State Police<\/a> have been using portable devices that allow them to secretly extract personal information from <a title=\"Mobile phone\" href=\"https:\/\/secure.wikimedia.org\/wikipedia\/en\/wiki\/Mobile_phone\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">cell phones<\/a> In an article on <a href=\"https:\/\/www.helpnetsecurity.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Help Net Security<\/em><\/a> the ACLU says that the troopers have used the devices on cell phones of people pulled over for minor traffic infractions as well as people suspected of a crime.<\/p>\n<p><a href=\"https:\/\/www.michigan.gov\/msp\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-7299 \" style=\"border: 0pt none; margin-left: 3px; margin-right: 3px;\" title=\"MSP_car\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/2011\/04\/MSP_car-e1564337222515-150x104.jpg?resize=128%2C89&#038;ssl=1\" alt=\"\" width=\"128\" height=\"89\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/2011\/04\/MSP_car-e1564337222515.jpg?resize=150%2C104&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/2011\/04\/MSP_car-e1564337222515.jpg?resize=75%2C52&amp;ssl=1 75w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/2011\/04\/MSP_car-e1564337222515.jpg?w=450&amp;ssl=1 450w\" sizes=\"auto, (max-width: 128px) 100vw, 128px\" \/><\/a>The article says most of the devices used are from <a title=\"Cellebrite\" href=\"https:\/\/www.cellebrite.com\/\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">CelleBrite<\/a> and can extract a great number of data from most cell phones, including contacts, text messages, deleted text messages, call history, pictures, audio and video recordings, memory file dumps, and more. <em><a title=\"http:\/\/www.geekosystem.com\/\" href=\"http:\/\/www.geekosystem.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">GeekOSystems<\/a><\/em> <a title=\"www.geekosystem.com\" href=\"http:\/\/www.geekosystem.com\/cellebrite-cellphone-hacker\/\" target=\"_blank\" rel=\"noopener noreferrer\">says<\/a> the Cellebrite UFED Physical Pro Scanner (<a title=\"Cellebrite\" href=\"https:\/\/web.archive.org\/web\/20120619113048\/http:\/\/www.cellebrite.com:80\/images\/stories\/brochures\/UFED%20Physical%20Pro%20Brochure%20%20ENGLISH.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">cut-sheet<\/a>), were tested by the U.S <a title=\"www.justice.gov\" href=\"http:\/\/www.justice.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\">Department of Justice<\/a>. The DOJ reported the device was capable of pulling all photos and video from an <a title=\"Apple\" href=\"http:\/\/www.apple.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Apple<\/a> (<a title=\"NASDAQ : AAPL\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-AAPL\/\" target=\"_blank\" rel=\"noopener noreferrer\">AAPL<\/a>) iPhone in under a minute and a half. Cellebrite says their devices also can extract, \u201cexisting, hidden, and deleted phone data, including call history, text messages, contacts, images, and geotags.\u201d It can also extract your highly incriminating ringtones. These devices can also get around password protection, and work on over 3,000 cellphone models according to the website.<\/p>\n<p><a href=\"https:\/\/www.cellebrite.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-7300\" style=\"border: 0pt none; margin-left: 3px; margin-right: 3px;\" title=\"Cellebrite UFED Physical Pro Scanner\" src=\"https:\/\/i0.wp.com\/rbachnet.wwwmi3-ss40.a2hosted.com\/wp-content\/uploads\/2011\/04\/Cellebrite-UFED-Physical-Pro-Scanner.jpg?resize=109%2C99\" alt=\"Cellebrite UFED Physical Pro Scanner\" width=\"109\" height=\"99\" \/><\/a>The ACLU is concerned that the MSP is using these devices to conduct warrantless searches without consent or a <a title=\"Search warrant\" href=\"https:\/\/secure.wikimedia.org\/wikipedia\/en\/wiki\/Search_warrant\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">search warrant<\/a> in violation of the <a title=\"Fourth Amendment to the United States Constitution\" href=\"https:\/\/secure.wikimedia.org\/wikipedia\/en\/wiki\/Fourth_Amendment_to_the_United_States_Constitution\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">4th Amendment<\/a> of the <a title=\"United States Constitution\" href=\"https:\/\/secure.wikimedia.org\/wikipedia\/en\/wiki\/United_States_Constitution\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">U.S. Constitution<\/a>. <em>Help Net Security<\/em> reports that the <a href=\"http:\/\/www.aclumich.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">ACLU of Michigan<\/a> has been requesting information about MSP&#8217;s use of these devices for nearly three years by filing <a title=\"Freedom of information legislation\" href=\"https:\/\/secure.wikimedia.org\/wikipedia\/en\/wiki\/Freedom_of_information_legislation\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">Freedom of Information Act<\/a> requests to the Michigan State Police. The ACLU wants the troopers to reveal the data it collected, but it has had no luck so far. The article indicates that the MSP is stonewalling the ACLU\u2019s Freedom of Information (FOIA) requests resulting in possible court action.<\/p>\n<p><a href=\"http:\/\/www.aclu.org\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-7301 \" style=\"border: 0pt none; margin-left: 3px; margin-right: 3px;\" title=\"ACLU_Logo\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/2011\/04\/ACLU_Logo-e1564337263775-150x63.gif?resize=131%2C55&#038;ssl=1\" alt=\"\" width=\"131\" height=\"55\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/2011\/04\/ACLU_Logo-e1564337263775.gif?resize=150%2C63&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/2011\/04\/ACLU_Logo-e1564337263775.gif?resize=75%2C31&amp;ssl=1 75w\" sizes=\"auto, (max-width: 131px) 100vw, 131px\" \/><\/a>Following those accusations, the Michigan State Police posted their side of the story in an <a href=\"https:\/\/web.archive.org\/web\/20150724165330\/http:\/\/www.michigan.gov\/msp\/0,1607,7-123-1586-254783--,00.html\" target=\"_blank\" rel=\"noopener noreferrer\">official statement<\/a> published on its website according to another <em>Help Net Security<\/em> article. The MSP says it has, \u201cfulfilled at least one ACLU <a title=\"Freedom of Information Act (United States)\" href=\"https:\/\/secure.wikimedia.org\/wikipedia\/en\/wiki\/Freedom_of_Information_Act_%28United_States%29\" target=\"_blank\" rel=\"noopener wikipedia noreferrer\">FOIA request<\/a> on this issue \u2026\u201d The web-posting also claims that devices that the MSP has in its possession can\u2019t extract data without the officer actually having the owner\u2019s mobile device in his hand and they claim the scanners are properly used, \u201cThe DEDs (data extraction devices) are not being used to extract citizens\u2019 personal information during routine traffic stops,\u201d it explains. \u201cThe MSP only uses the DEDs if a search warrant is obtained or if the person possessing the mobile device gives consent.\u201d<\/p>\n<p><strong><em>rb-<\/em><\/strong><\/p>\n<p><em>Wonder why the government keeps trying to make talking on a cell phone while driving a primary offense? Could it be so the government has an excuse to stop people and collect their personal data? The last sentence from the MSP is particularly chilling since people are strongly encouraged to cooperate with the police even when they know they did nothing criminal.
