The social network must stop the program for Germans and delete all data already collected on German users or face fines up to \u20ac300,000 ($430,560), says Johannes Caspar, head of the Hamburg Data Protection Authority, reports <a title=\"news.ebrandz.com\" href=\"http:\/\/news.ebrandz.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>eBrandz.com<\/em><\/a>.<\/p>\n<p><a href=\"https:\/\/www.facebook.com\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-106374 size-full\" title=\"Facebook logo\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/facebook_icon-1.jpg?resize=59%2C58&#038;ssl=1\" alt=\"Facebook logo\" width=\"59\" height=\"58\" \/><\/a>Mr. Casper notified the Palo Alto, CA firm that the company&#8217;s facial recognition application which is active by default amounts to unauthorized <a title=\"Data collection\" href=\"http:\/\/en.wikipedia.org\/wiki\/Data_collection\" target=\"_blank\" rel=\"wikipedia noopener noreferrer\">data collection<\/a> on individuals. Mr. Caspar gave Facebook two weeks to respond. &#8220;<em>Should Facebook plans to continue the function, it must ensure that only data from persons who have granted their approval to the storage of their biometric facial profiles be stored in the database,<\/em>&#8221; he said.<\/p>\n<p>The software offered the potential for &#8220;considerable abuse&#8221; and was illegal. &#8220;<em>If the users&#8217; data lands into the wrong hands, it would be possible to compare and identify anybody captured in a photo taken with a mobile phone,<\/em>&#8221; Mr. Caspar told the <em>Hamburger Abenblatt<\/em> newspaper.<\/p>\n<p><a href=\"https:\/\/web.archive.org\/web\/20110908165404\/http:\/\/real-agenda.com:80\/2011\/08\/04\/facebook-biometrics-declared-illegal-in-germany\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-106376 size-medium\" title=\"Facebook facial recognition application\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/facebook-recognition-face.jpg?resize=150%2C74&#038;ssl=1\" alt=\"Facebook facial recognition application\" width=\"150\" height=\"74\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/facebook-recognition-face.jpg?w=150&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/facebook-recognition-face.jpg?resize=75%2C37&amp;ssl=1 75w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><\/a>The Facebook application tries to find faces on uploaded photos according to physical features and automatically saves them, creating &#8220;<em>the world&#8217;s largest database of biometric features,<\/em>&#8221; according to <em>Bloomberg. <\/em>The program attempts to compare data captured in a picture with the trove of data it has already collected from its hundreds of millions of users.<\/p>\n<p>Users can opt-out of the automatic tagging, but Facebook can still gather and store (indefinitely) all photos added to the site. &#8220;This is what is most troublesome. The program feeds off a stock of data designed to physically identify millions of users,&#8221; Mr. Casper said.<\/p>\n<p>&#8220;<em>The legal situation is clear in my opinion,<\/em>&#8221; Caspar told the newspaper that such a system could be exploited by undemocratic governments to spy on the opposition or by security services around the world. &#8220;<em>The right to anonymity is in danger,<\/em>&#8221; he said.<\/p>\n<p><a href=\"https:\/\/www.madmagazine.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-106378\" title=\"could be exploited by security services around the world.\" src=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/spyvsspy.jpg?resize=100%2C75&#038;ssl=1\" alt=\"could be exploited by security services around the world.\" width=\"100\" height=\"75\" srcset=\"https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/spyvsspy.jpg?w=150&amp;ssl=1 150w, https:\/\/i0.wp.com\/rbach.net\/wp-content\/uploads\/spyvsspy.jpg?resize=75%2C56&amp;ssl=1 75w\" sizes=\"auto, (max-width: 100px) 100vw, 100px\" \/><\/a>The German federal consumer protection ministry backs Mr. Casper. &#8220;<em>We expect Facebook to comply with all European and German data protection standards and for it to respond to the request from the Hamburg regional data protection officer,<\/em>&#8221; said a spokeswoman.<\/p>\n<p>As expected Facebook denies any wrongdoing and responded, &#8220;<em>We will consider the points the Hamburg Data Protection Authority have made about the &#8216;photo tag suggest&#8217; feature, but &#8220;firmly rejected any accusations that we are not complying with our obligations to European Union data protection laws<\/em>&#8221; reports <em>eBrandz<\/em>.<\/p>\n<p>American web 2.0 companies have often had problems in <a title=\"Germany\" href=\"http:\/\/maps.google.com\/maps?ll=52.5166666667,13.3833333333&amp;spn=10.0,10.0&amp;q=52.5166666667,13.3833333333%20%28Germany%29&amp;t=h\" target=\"_blank\" rel=\"geolocation noopener noreferrer\">Germany<\/a> which takes online privacy much more seriously than the US. <em>Bloomberg<\/em> says German privacy laws restrict photographs of people and property except in public places without a person&#8217;s consent. These policies have also caught <a href=\"http:\/\/www.microsoft.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Microsoft&#8217;s<\/a> (<a href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-MSFT\/\" target=\"_blank\" rel=\"noopener noreferrer\">MSFT<\/a>) <a title=\"Bing\" href=\"http:\/\/www.bing.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Bing<\/a> <a title=\"Bing Maps\" href=\"https:\/\/www.bing.com\/maps\/\" target=\"_blank\" rel=\"noopener noreferrer\">Maps<\/a> <a title=\"Bing Maps Streetside\" href=\"https:\/\/web.archive.org\/web\/20130220064026\/http:\/\/www.bing.com\/community\/site_blogs\/b\/maps\/archive\/2010\/02\/11\/new-bing-maps-application-streetside-photos.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">Streetside<\/a> service and\u00a0<a title=\"Google\" href=\"https:\/\/www.google.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Google\u2019s<\/a> (<a title=\"NASDAQ : GOOG\" href=\"https:\/\/www.tradingview.com\/symbols\/NASDAQ-GOOG\/\" target=\"_blank\" rel=\"noopener noreferrer\">GOOG<\/a>) <a title=\"maps.google.com\/\" href=\"http:\/\/maps.google.com\/intl\/en\/help\/maps\/streetview\/#utm_campaign=en&amp;utm_medium=van&amp;utm_source=en-van-na-us-gns-svn\" target=\"_blank\" rel=\"noopener noreferrer\">Streetview<\/a> ran afoul Germany&#8217;s privacy laws.<\/p>\n<p><em><strong>rb-<\/strong><\/em><\/p>\n<p><em>Facebook users should have noticed the automatic tagging application, which finds your friends when you upload photos. Like with many Facebook &#8220;features&#8221; it is, in my opinion intentionally hard for the average user to switch off &#8211; and is on by default.<\/em><\/p>\n<p><em>In the US, privacy is a joke.\u00a0 I have covered firms like <a title=\"Rapleaf\" href=\"https:\/\/web.archive.org\/web\/20140806055704\/http:\/\/www.rapleaf.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Rapleaf<\/a> several times <a title=\"rbach.net\" href=\"https:\/\/wp.me\/p2wgaW-vP\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a> and <a title=\"rbach.net\" href=\"https:\/\/wp.me\/p2wgaW-117\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>. In Germany, their history drives them to take privacy seriously. They are rightfully suspicious of large collections of personal data that can be turned over to the State and used to categorize people. Facebook has over 750 million users, most of which don&#8217;t care about their privacy and help Facebook build the world&#8217;s largest biometric database.
